HC stays order cancelling admission of student in college

The Bombay High Court has stayed an order of Jamnalal Bajaj Institute of Management Studies cancelling the admission of a student.

Hearing the plea of the student, a division bench stayed the order of January 5 this year and asked the student to attend the college.

Justices S S Khemkar and P D Naik stayed the impugned order yesterday and issued notices to the Institute and Director of Technical Education to hear them on the issue raised in the petition.

The lawyers of the petitioner, Swapna Kode and Rizwan Merchant, argued that the institute had not given a hearing to the student, thereby violating his fundamental right.
 

Moreover, the order of the Institute did not give any reason for cancelling the admission, they argued and sought a stay on the impugned order.

The Institute said it had written a letter to the student alleging he had submitted a false caste certificate.

The High Court, observing that the student should have been given a hearing, stayed the order and issued notices to the respondents.
