Trump sex abuse accuser to testify in defamation trial over his denials

Less than a year after convincing a jury that former President Donald Trump sexually abused her decades ago, writer E. Jean Carroll is set to take the stand again to describe how his verbal attacks affected her after she came forward. Carroll is due to testify on Wednesday in the second federal civil trial over her claims against Trump, who denies them all. Because the first jury found that Trump sexually abused Carroll in the 1990s and then defamed her in 2022, the new trial concerns only how much more if anything he'll be ordered to pay her for some other remarks. He made them while he was president. Trump, who is juggling court appearances with campaign stops as he leads the Republican field in this year's presidential race, sat in on jury selection on Tuesday. Before opening statements began, he left for a New Hampshire rally. He declared on social media on Tuesday that the case was nothing but fabricated lies and political shenanigans" that had garnered his accuser money and

Trial begins to determine how much Trump owes for calling rape accuser liar

Donald Trump shook his head in disgust Tuesday as the judge in his New York defamation trial told prospective jurors that another jury had already decided the former president sexually abused columnist E Jean Carroll in the 1990s. Fresh from a political win Monday in the Iowa caucuses, the Republican presidential frontrunner detoured to a Manhattan courtroom for what amounts to the penalty phase of a civil defamation lawsuit stemming from Carroll's claims he sexually attacked her in a department store dressing room. Prospective jurors were told the trial was likely to last three to five days. Opening statements come next. Trump did not attend the previous trial in the case last May, when a jury found he had sexually abused Carroll and awarded her $5 million in damages. In light of that verdict, Judge Lewis A Kaplan told prospective jurors the trial beginning Tuesday would focus only on how much money, if any, Trump must pay Carroll for comments he made about her while president in .

Madras HC convicts ex-IPS officer Sampath Kumar in Dhoni's contempt plea

The Madras High Court on Friday imposed a punishment of 15 days' simple imprisonment on retired IPS officer G Sampath Kumar in a contempt of court case filed by former Indian cricket team captain Mahendra Singh Dhoni. A division bench comprising Justices S S Sundar and Sunder Mohan found Sampath Kumar guilty of committing criminal contempt. "However, taking into consideration the credentials of the respondent (Sampath Kumar), as projected by him in his written statement as well in the reply affidavit, this court, showing lenience, restricts the punishment for a period of 15 days." "Even though a request is not received from the side of the respondent, this court is inclined to exercise its power under section 19 (3) of the Contempt of Courts Act and suspend the execution of punishment imposed on the respondent by this court, for a period of 30 days" (to enable him file an appeal). Defamation case: Sultanpur court summons Rahul over remarks on Amit Shah

An MP-MLA court has summoned Congress leader Rahul Gandhi in a 2018 defamation case over alleged "objectionable" comments he made against Union minister Amit Shah, the petitioner's counsel said. During a hearing on the case on Monday, MP/MLA court judge Yogesh Yadav summoned Gandhi on December 16, advocate Santosh Pandey said. The defamation case was filed by BJP leader Vijay Mishra in 2018 against the Congress leader for allegedly making "objectionable" comments against Shah at a press conference in Bengaluru. The complainant had referred to Gandhi's comment that the BJP which claims to believe in honest and clean politics has a party president who is an "accused" in a murder case. Shah was the BJP president when Gandhi made the remark. About four years before Gandhi's remark, a special CBI court in Mumbai had discharged Shah in a 2005 fake encounter case when Shah was a minister of state for home in Gujarat.

Judge tosses Trump's countersuit against writer who won lawsuit against him

A federal judge tossed out former President Donald Trump's countersuit against the writer who won a sex abuse lawsuit against him, ruling on Monday that Trump can't claim she defamed him by continuing to say she was not only sexually abused but raped. The ruling shuts down, at least for now, Trump's effort to turn the legal tables on E. Jean Carroll, who won a USD 5 million judgment against him in May and is pursuing her own defamation suit against him. Trump attorney Alina Habba said his lawyers would appeal the flawed decision to dismiss his counterclaim. Carroll's lawyer, Robbie Kaplan, said she was pleased with the ruling and looking ahead to a trial scheduled in January in her defamation suit, which concerns a series of remarks that Trump has made in denying her sexual assault allegation. E. Jean Carroll looks forward to obtaining additional compensatory and punitive damages" in that trial, Kaplan said. Carroll accused Trump of trapping her in a luxury department store dressin

Hearing of defamation case filed against Rahul by RSS activist adjourned

A magistrate's court at Bhiwandi in Maharashtra's Thane district on Saturday adjourned the hearing of a criminal defamation case filed by an RSS worker against Congress leader Rahul Gandhi, as a related matter is before the High Court. Judicial Magistrate (First Class) L C Wadikar scheduled the next hearing for September 16, said advocate Narayan Iyer, Gandhi's lawyer. Rajesh Kunte, a local worker of the Rashtriya Swayamsevak Sangh, had in 2014 filed the case over the Congress leader's alleged statement at an election rally near Bhiwandi on March 6, 2014, that "the RSS people killed (Mahatma) Gandhi." He, thus, defamed the RSS by making a false claim, Kunte said. Kunte was to be cross-examined by the defence on Saturday, but Gandhi's lawyer sought adjournment. The Congress leader has approached the Bombay High Court challenging the magistrate's decision to accept certain documents presented by Kunte as exhibits in the case, and till the HC decides the matter, the magistrate should

Modi surname row: Purnesh Modi's original surname not Modi, Rahul tells SC

Congress leader Rahul Gandhi on Friday told the Supreme Court that the original surname of former Gujarat minister Purnesh Modi, who filed a defamation case against him, is not Modi and he belongs to the Modh Vanika Samaj. Senior advocate Abhishek Singhvi, appearing for Gandhi, told a three-judge bench of Justices B R Gavai, P S Narasimha and Sanjay Kumar that his client is not a hardened criminal and there is no conviction in any case despite several cases filed against him by BJP workers. The top court is hearing a plea by Gandhi challenging the Gujarat High Court verdict which dismissed his plea seeking a stay on his conviction in a defamation case over his "Modi surname" remark. Purnesh Modi had filed a criminal defamation case in 2019 against Gandhi over his "How come all thieves have Modi as the common surname?" remark made during an election rally in Kolar in Karnataka on April 13, 2019.

Defamatory remarks against PM Modi: HC extends interim relief for Rahul

The Bombay High Court on Wednesday extended till September 26 the interim relief granted to Congress leader Rahul Gandhi from appearance before a local court here in a defamation complaint pertaining to his alleged remarks against Prime Minister Narendra Modi in 2018. The complainant, who claims to be a BJP worker, had alleged that Gandhi's "commander-in-thief" remark in the context of the Rafale fighter jet deal amounted to defamation. A single bench of Justice S V Kotwal adjourned the hearing till September 26 on the plea filed by Gandhi challenging the summons issued to him by the local court in 2021. "The interim relief granted earlier will continue till then," Justice Kotwal said. Gandhi's plea was adjourned after the complainant's lawyer sought time.
