Excise policy scam: HC lists for July 11 Kejriwal's plea against ED summons

The Delhi High Court on Wednesday listed for hearing on July 11 Chief Minister Arvind Kejriwal's petition challenging the summonses issued to him by the Enforcement Directorate (ED) in connection with its probe into the excise policy-linked money laundering case. A bench headed by Justice Suresh Kumar Kait granted four more weeks to the AAP leader, who was given interim bail till June 1 by the Supreme Court for campaigning in the Lok Sabha Elections, to file a rejoinder to the reply submitted by the ED. The counsel for the ED has earlier said the petition against the summonses was infructuous after Kejriwal's arrest by the agency on March 21 in the money laundering case following the high court's refusal to grant him interim protection from coercive action. On Wednesday, the agency's lawyer said the petitioner must choose the forum before which he would press his issues. The court also observed that a single judge of the high court, while rejecting the AAP leader's petition against

Delhi HC dismisses plea on direction to ECI to take action against PM Modi

The Delhi High Court on Monday dismissed a plea seeking direction to the Election Commission of India to take action against Prime Minister Narendra Modi for allegedly delivering communally divisive speeches during Lok Sabha poll campaigning in violation of the Model Code of Conduct. Justice Sachin Datta said the plea was misconceived and devoid of merits and the ECI can take an independent view on the complaint of the petitioner in accordance with law. The court also referred to its earlier order passed in a plea pertaining to a speech given by the prime minister allegedly seeking votes in the name of religion and deities and went on to say that making any presupposition is unjustified. The counsel for the ECI submitted that it has issued a detailed advisory to all political parties. It said that appropriate action shall be taken if necessary on the reply. The petitioner's counsel said the ECI cannot have different standards for taking action against different politicians. The pl

Delhi excise policy: ED files fresh charge sheet; names Kavitha, 4 others

The Delhi High Court on Friday sought the stand of the Enforcement Directorate on the bail plea by BRS leader K Kavitha in a money laundering case in connection with the alleged excise policy scam. Justice Swarana Kanta Sharma listed the matter for further hearing on May 24. Kavitha has challenged the trial court's May 6 order by which her bail application was dismissed in the money laundering case. The trial court had also rejected her bail plea in the corruption case lodged by the CBI in connection with the "scam". The alleged scam pertains to the alleged corruption and money laundering in formulating and executing the Delhi government's excise policy for 2021-22 that was later scrapped. Kavitha is in judicial custody in the two cases lodged by the CBI and the ED, respectively. The ED arrested Kavitha (46) from her Banjara Hills residence in Hyderabad on March 15. The CBI arrested the Bharat Rashtra Samithi (BRS) leader when she was already under judicial custody in the ED case

Seek review of ruling on non-consensual intimate pics: HC to Google, MS

The Delhi High Court on Monday asked Microsoft, which owns 'Bing', and Google to seek a review of an order by a single judge directing them to identify and de-index non-consensual intimate images without requesting for their specific URLs, after the search engine giants filed an appeal against the ruling. The senior counsel for the appellants said unlike in cases of child sexual abuse material, non-consensual intimate images cannot be detected by their current technology and therefore it was not possible for them to comply with the order passed by the single judge in April 2023. Their senior lawyers assured the court a new technology is being developed but it has not yet reached a stage where it can detect such non-consensual content on its own. They said the search engines do not "host" any content, and once an objectionable content has been removed from the site hosting it, it will not appear in search results as well. Stating that "no one can ask you to do the impossible", a ben

HC asks Centre to respond to plea on non-regulation of deepfake technology

The Delhi High Court on Wednesday sought the Centre's response on a PIL by veteran journalist Rajat Sharma against non-regulation of deepfake technology in the country and seeking directions to block public access to applications and software enabling creation of such content. A bench of Acting Chief Justice Manmohan and Justice Manmeet PS Arora issued notice to the Union Ministry of Electronics and Information Technology on the petition. Deepfake technology facilitates creation of realistic videos, audio recordings and images that can manipulate and mislead viewers by superimposing the likeness of one person onto another, altering their words and actions, thereby presenting a false narrative or spreading misinformation. The bench said it was a major problem and sought to know from the central government if it was willing to act on the issue. Political parties are complaining about this as well. You are not taking any action, the court said. Rajat Sharma, the Chairman and ...

Delhi HC dismisses PIL seeking facilities for CM Kejriwal in jail

The Delhi High Court on Wednesday dismissed with Rs 1 lakh costs a public interest litigation by a lawyer seeking appropriate arrangements for Chief Minister Arvind Kejriwal to run the government from jail. The petitioner also sought to restrain Delhi BJP president Virendra Sachdeva from exerting any "undue pressure" for resignation of Kejriwal. A bench headed by Acting Chief Justice Manmohan observed that since the AAP leader has already approached the Supreme Court against his arrest, "no orders were called for" with regard to providing him any facilities while in judicial custody. The bench, also comprising Justice Manmeet PS Arora, further said the court cannot impose censorship on the media or stop political rivals from making statements. "Do we impose emergency? We impose censorship? We impose martial law? How do we gag the press? The political rivals?" the court said. "Keep bank draft of Rs 1 lakh ready," the court told the petitioner. The petitioner argued that although i

Children need to be taught about dangers of 'virtual' world: Delhi HC

Teaching minors about good touch' and bad touch' is not enough in today's virtual world and children must be educated on the emerging concept of virtual touch' and its potential dangers, the Delhi High Court has said. This involves teaching them appropriate online behaviour, recognising warning signs of predatory behaviour and understanding the importance of privacy settings and online boundaries. This court is constrained to note that in today's virtual modern world where virtual space has also become a breeding ground of alleged virtual affections between teenagers, they are not equipped to deal with the potential dangers of human trafficking for prostitution and other side of crimes which exists in the virtual world, Justice Swarana Kanta Sharma said on Monday. The high court's observations came while dismissing a bail plea by a woman, Kamlesh Devi, accused of helping her son in sexually assaulting a minor girl after kidnapping her and forcing her into prostitution. HC gives 3 mths to trial court to conclude Haryana judicial paper-leak case

The Delhi High Court has granted three more months to a trial court to conclude the proceedings in a case relating to the alleged leak of the 2017 Haryana Civil Services (Judicial) preliminary examination paper. It was earlier directed that the hearing in the matter be taken up on a daily basis. Justice Dinesh Kumar Sharma said the court would appreciate if the principal district and sessions judge, before whom the trial is going on, posts the matter on a day-to-day basis and grants adjournments to the parties only for unavoidable reasons. The high court had, in January, asked the trial court to expedite the proceedings in the case and take it up on a daily basis. Pursuant to the last order, the trial court judge submitted a letter to the high court, stating that the case record is voluminous as seven chargesheets have been filed against the accused who are facing trial. There are 19 accused and 85 witnesses in the case, which is at the stage of defence evidence, the trial court j
