The highest court of Belgium -- Court of Cassation-- has rejected the appeal of fugitive diamantaire Mehul Choksi against India's extradition request, while endorsing a lower court's view that there are no grounds for his claims of flagrant denial of justice, torture or inhuman and degrading treatment in India, according to the order released on Wednesday.
Imposing costs of Euros 104 on Choksi, the court upheld the view of the Indictment Chamber of Antwerp Court of Appeal, which had observed that the documentation provided by Choksi was insufficient to make it concretely plausible that he runs a real, present and serious risk of being subjected to flagrant denial of justice or to torture or inhuman and degrading treatment in the requesting State.
The Court of Cassation does not re-examine the facts or decide whether extradition is fair or wise. Its role is limited to checking whether the law was applied correctly, and whether procedural rules and reasoning duties were respected.

In a significant judgment, the Gujarat High Court on Wednesday rejected nearly 150 petitions from Muslim Waqf institutions seeking exemption from payment of fees to the State Waqf Tribunal to access a court of law.
Justice JC Doshi dismissed the petitions, many of which involved contested rent claims, possession disputes, and rights of occupancy over key properties across the state.  Waqf trusts such as Sunni Muslim Idgah Masjid Trust, the Vadodara Saher Masjid Sabha Trust, and the Sarkhej Roza Committee in Ahmedabad, had challenged orders of the Gujarat State Waqf Tribunal requiring payment of court fees before their disputes could be heard.  The court observed that they had sought reliefs before the tribunal which were adversarial in character wherein rights and obligations of contesting parties are required to be judicially determined. Healthcare industry body NATHEALTH has asked the government to increase public spending on healthcare to over 2.5 per cent of GDP with urgent action to tackle non-communicable diseases, including tax deductions of up to Rs 10,000 on individuals for preventive health check-ups.
In its pre-Budget recommendations to the government, NATHEALTH said it outlined a roadmap to strengthen healthcare delivery, foster innovation, and expand insurance and preventive coverage.
The recommendations call for a balanced mix of fiscal support, structural reforms, and public-private collaboration to build a robust, future-ready health system, it said in a statement.
In its recommendations, NATHEALTH asked the sector to be declared 'core infrastructure' and create a healthcare infrastructure fund of Rs 50,000 crore, saying currently there is limited access to long-term, lower-cost capital for hospitals and diagnostic networks.
