Loud gym music source of nuisance in residential areas: NGT

The National Green Tribunal has termed loud music from gyms located in residential areas as source of "nuisance" and restrained a health club in East Delhi from playing music in and around it.
A bench headed by Justice U D Salvi, which had earlier issued notices to the Delhi Pollution Control Committee and assistant commissioner of police, warned the gym that "if the use of amplifying system is not stopped, coercive measures shall be resorted to".
"We do see reason in the premise that the excitement caused by the sound/music amplifying system is the source of nuisance which cannot go hand in hand with the exercise for which the gym is meant for.

"We therefore, injunct Respondent no 5 (gym) from using any amplifier for music system in the gym or in any premises around it," the bench said.
The green panel was hearing a plea by East Delhi residents seeking directions for closure of Body Mechanics Gym and Spa Centre in Ram Vihar alleging it was creating noise pollution in the area.
"The gym and spa plays very loud music on power amplifiers which generates a lot of noise that irritates the inhabitants and causes vibration in the wall.
"Besides this, 50 to 100 vehicles are being parked on the road and on the pedestrian path which obstructs the way of the vehicles and pedestrians resulting air pollution and noise pollution," the plea, filed through advocate Sachin Jain, said.

The residents have further stated that they approached the statutory authorities "number of times" to take appropriate steps against the "erring" gym for causing pollution but no effective steps have been taken till date.
