Appellate tribunal NCLAT has said the fair trade regulator Competition Commission of India has no power to examine into the disputes related to patent matters. Dismissing an appeal against a CCI order, in which the regulator had closed a complaint against Swiss pharma major Vifor International (AG), a two-member NCLAT bench said the 'Patent Act will prevail over the Competition Act'. Citing the earlier judgments, NCLAT said: "Considering the judgment of the Delhi High Court in the case of Telefonaktiebolaget LM Ericsson (PUBL) and the Supreme Court in the SLP No. 25026/2023, it is apparent that the CCI lacks the power to examine the allegations made against Vifor International (AG)." NCLAT, which is an appellate authority over the orders passed by CCI, said Vifor International had the patent for Ferric Carboxymaltose (FCM) injection, which is required for the treatment of Iron Deficiency Anaemia (IDA). Ola Group, spanning ride-hailing, electric vehicles, and AI, now holds over 50 per cent of all patents filed by India's 117 unicorns. India's unicorns collectively hold only 229 patents, with Ola Group owning more than half, according to data from the Indian Patent Advanced Search (IPAS) System. In a recent post on X (formerly Twitter), Ola Founder Bhavish Aggarwal shared, "Happy that Ola group @OlaElectric @Olacabs and @Krutrim have half of all granted patents for all Indian unicorns put together. Not happy with our number of 650 applied patents though. We will accelerate much much more in coming years!" Tata Motors on Thursday said it has filed 250 patents and 148 design applications, its highest-ever in a single year, in FY25. The filings encompass a broad spectrum of product and process innovations, aligning with key automotive megatrends such as Connectivity, Electrification, Sustainability, and Safety (CESS), as well as emerging technologies like hydrogen-based vehicles and fuel cells, the Mumbai-based auto major said in a statement. Additionally, they cover various vehicle systems, including battery, powertrain, body and trim, suspension, brakes, HVAC, and emission control, it added. The company said it also filed 81 copyright applications and secured 68 patent grants during the year, bringing its total granted patents to 918. Indian blockchain technology startup Grow Digi has been granted two patents comprising technology that reduces need for data storage by about 95 per cent, reduced time for transactions and enhances security, a top official of the firm said. Grow Digi Founder and Managing Director Sachin Kumar told PTI that the bootstrapped company has developed a layer 1 or base layer of blockchain technology with base in India that will allow enterprises to develop their blockchain-based applications. "We have been granted two patents from the government's patent office. We are the first Indian firm to have layer 1 registered in India. The patents will reduce data storage requirement by 95 per cent in the blockchain as well as reduce transaction time from minimum of 5 seconds to less than 300 millisecond," Kumar said. The Indian patent office has cautioned people against fraudsters who are collecting data and status of IP (intellectual property) applications from the website and seeking money to facilitate those applications. "It is, therefore, advised to all the stakeholders who are applying or may have applied for any type of IP applications (i.e. Patents, Designs, Trade Marks, GIs (geographical indications), Designs or Copyright) that they should not fall prey to such false claims and pay any money against these claims," the Office of the Controller General of Patents, Designs and Trademarks has said in a public notice. It said that these applications are processed strictly as per provisions of law and this office has zero tolerance for any such unethical practices.
