'One flag, one PM, one constitution' not a political slogan: Shah in LS

Union Home Minister Amit Shah Tuesday asserted that the concept of "one flag, one prime minister, one constitution" was not a political slogan and the BJP firmly believes in the principle and finally implemented it with regard to Jammu and Kashmir. Responding to a remark by TMC's Saugata Roy in the Lok Sabha that "ek nishan, ek pradhan, ek samvidhan (one flag, one head, one constitution)" was a "political slogan", Shah wondered as to how can a country have two prime ministers, two constitutions and two flags. He said Roy's remarks were "objectionable". While responding to a remark from the opposition benches, Shah said, "Whosoever did it was wrong. Narendra Modi has corrected it. Your approval or disagreement does not matter. The entire country wanted it." This comment was made in an apparent reference to the abrogation of provisions of Article 370 in Jammu and Kashmir. He went on to state that "one symbol, one head, one constitution" was not an election slogan. "We had been saying

SC dismisses plea seeking declaration that abrogation of Art 370 valid

The Supreme Court on Monday dismissed a petition seeking a declaration that abrogation of Article 370 of the Constitution, which bestowed special status on the erstwhile state of Jammu and Kashmir, was constitutionally valid. Terming the plea as "misconceived", a bench headed by Chief Justice D Y Chandrachud said the issue of constitutional validity of abrogation of Article 370 is already pending before a constitution bench of the apex court. "What kind of a petition is this? You are now seeking a declaration by this court that the abrogation of Article 370 is valid. Why should we issue that declaration on your petition? Who has set your client up?" the bench, also comprising Justices J B Pardiwala and Manoj Misra, asked the counsel appearing for the petitioner. The bench noted that the petitioner has filed a public interest litigation (PIL) seeking a declaration to the effect that abrogation of Article 370 (1) of the Constitution and the deletion of Article 35-A were constitutional

Art 370: SC questions issuance of constitutional orders for J-K post 1957

The Supreme Court on Thursday questioned the issuance of several constitutional orders which allowed provisions of the Indian Constitution to be applied in Jammu and Kashmir post 1957. The top court was referring to the Constitution (Application to Jammu and Kashmir) Amendment Orders passed since 1957 till August 6, 2019. A five-judge bench headed by Chief Justice D Y Chandrachud expressed surprise to the submission of senior advocate Dushyant Dave, appearing for a petitioner, that Article 370, which bestowed special status on the erstwhile state of Jammu and Kashmir, had lived its life and achieved its purpose. Unlike other senior lawyers, including Kapil Sibal and Gopal Subramanium, Dave argued that Article 370 has not in entirety assumed a permanent character and has lived its worth with the term of the Constituent Assembly of Jammu and Kashmir coming to an end in 1957. "I respectfully submit that Article 370 has lived its life. It has achieved its purpose. Now, Article 370 (1)
