Deprecating the practice of courts keeping bail applications pending for years, the Supreme Court has said that even a single day's delay in deciding such matters adversely affects the fundamental rights of citizens. The apex court has time and again emphasised the importance of personal liberty, a bench of Justices B R Gavai and K V Viswanathan said in an order passed on Friday. "It has been observed by this court (that) even a single day('s) delay in deciding the bail application adversely affects the fundamental rights of the citizens," it said. "We do not appreciate the practice of keeping bail application pending for years together," it said. The Supreme Court on Friday said it was not the American Supreme Court as it dismissed a plea seeking directions for the disposal of cases pending before all the courts in the country within a fixed time frame. A bench of Chief Justice of India D Y Chandrachud, Justices J B Pardiwala and Manoj Misra observed that the plea sought disposal of all cases in courts, including the apex court, between 12 and 36 months. Over 5.56 lakh First Information Reports (FIRs) have been registered across the country under the Bharatiya Nyaya Sanhita (BNS) ever since its introduction on July 1, a senior official said on Wednesday. For smooth implementation of the new criminal laws, the Ministry of Home Affairs (MHA) has also developed several mobile applications, including e-Sakshya for capturing, storing and retrieving evidence through videography and photography. The app has been adopted by 22 states and Union Territories and tested by 24 states and UTs. The Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Act replaced the colonial-era Indian Penal Code, the Code of Criminal Procedure and the Indian Evidence Act of 1872 respectively. The Bihar government has directed all DMs to ensure that unregistered temples, mutts, and trusts in their respective areas are registered and details of their immovable assets are submitted to the Bihar State Board of Religious Trusts (BSBRT) for uploading on its website. The BSBRT operates under the state's law department. State Law Minister Nitin Nabin on Thursday told PTI, "All district magistrates (DMs) have been directed to ensure that unregistered temples, mutts, and trusts are registered on a priority basis." He also instructed the DMs to ensure that details of immovable assets of all registered temples and mutts are promptly provided to the BSBRT for uploading on its website. "I recently sent a letter to all DMs in this regard. So far, only 18 districts have submitted data to the BSBRT," he added.
