The Mumbai police will chargesheet Nadeem Akhtar Saifee, music director and prime accused in the Gulshan Kumar murder case, in the metropolitan magistrates court by November 30, special public prosecutor, Ujjwal Nikam, said here yesterday. Nikam, returned on Tuesday from London. pti against nadeem, told pti that the magistrate would then commit the case to a trial court.
He said +in the normal course, we cannot proceed with charges levelled against the accused but under section 299 of cr.Pc, the prosecution is empowered to lead evidence against an accused in his absence, and the mumbai police is examining this aspect+.
A similar exercise had been followed in the serial blast case in which several accused had been tried in their absence as they were reported to be absconding, he added.
On the extradition of nadeem, mr nikam said mumbai police had a fairly good case against him as there is substantial evidence disclosing his involvement in the crime. However, he refused to elaborate on what evidence had been gathered.
