Planning a corridor at Banke Bihari Temple in Mathura: UP govt tells HC

The Uttar Pradesh government on Tuesday informed the Allahabad High Court that the government is planning to construct a corridor after acquiring five acres of land adjacent to Banke Bihari Temple in Mathura to give facilities to pilgrims. A bench comprising Chief Justice Rajesh Bindal and Justice JJ Munir was hearing a PIL on providing facilities to pilgrims who visit the temple in large numbers. Two devotees were killed and seven injured in a stampede-like situation at the temple during Janmashtami celebrations in August, sparking safety concerns. The bench asked the state government to clear its stand regarding the management of pilgrims visiting the temple and fixed the next hearing on November 17. High Court dismisses pleas to quash criminal proceedings against Azam Khan

The Allahabad High Court on Friday dismissed a bunch of pleas seeking quashing of criminal proceedings against Samajwadi Party leader Azam Khan in cases of alleged forcible possession of land for Rampur's Jauhar University. An FIR in this regard was lodged on September 12, 2019 by a revenue officer. After the registration of the case, several other complaints were filed, with the complainants alleging that their land was taken away forcibly by abducting and physically assaulting them. After going through records and submissions, Justice Samit Gopal observed," The allegations in the FIRs reveal as to how the respective first informants were abducted, assaulted, threatened and their land was forcibly taken from them by coercion and not following the due process of law." "Looking at the facts of the case, the prima facie allegation against the applicants and the law well settled as stated above, no case for interference is made out," the court said while dismissing the petitions.

Allahabad HC extends stay on survey at site in Gyanvapi case till Oct 31

The Allahabad High Court on Wednesday extended the stay till October 31 on a Varanasi court order directing the Archaeological Survey of India to conduct a survey at the Kashi Vishwanath temple-Gyanvapi mosque complex and further proceedings in this case. Justice Prakash Padia, after hearing the parties concerned, fixed October 18 as the next date of hearing in the case. On August 30, the high court had extended the interim stay till September 30 on the Varanasi court's order dated April 8, 2021. The Anjuman Intezamia Masjid, the Gyanvapi mosque management committee of Varanasi, had filed a petition challenging the maintainability of an original suit filed in 1991 in the Varanasi district court. Lucknow Bench sentences Mukhtar Ansari five-year jail in Gangster Act case

The Lucknow Bench of the Allahabad High Court on Friday sentenced former MLA Mukhtar Ansari to five-year imprisonment in a 23-year-old case related to the Gangster Act. Justice D K Singh passed the order overturning the acquittal by a special MP-MLA court in 2020. The court also imposed a fine of Rs 50,000 on Ansari. State counsel Rao Narendra Singh said the FIR was lodged with the Lucknow's Hazratganj police in 1999 and a special court had acquitted Ansari in 2020. The state had filed an appeal against acquittal in 2021. The High Court on Friday allowed the state government's appeal and sentenced Ansari to five years in jail, he said. Allahabad HC pulls up state govt for lapses in Lucknow hotel fire case

The Allahabad High Court on Thursday pulled up the state government for alleged lapses in regulation of development and housing authorities, in connection with a PIL on a fire incident at a Lucknow hotel. The Lucknow bench of Allahabad High Court expressed dissatisfaction as the state's lawyer could not place proper replies to its queries in connection with the PIL. The court had taken suo motu cognisance of the fire at the Levana Suites hotel in the posh Hazratganj area in the city earlier this month in which four guests were killed and several injured. A bench of justices D K Upadhyay and Saurabh Srivastava was hearing the PIL. The Allahabad High Court has directed the senior superintendent of police (SSP), Jhansi to ensure that the FIR of a petitioner, whose husband was killed in a police encounter in 2019, be lodged with her version that the man was killed in a fake encounter. The court has directed the SSP and the station house officers (SHOs) of the Gursahay and Moth police stations in Jhansi to ensure that the FIR of petitioner Shivangi Yadav be lodged with her version that her husband was killed in a fake police encounter. Gyanvapi case: HC fixes Sept 28 as next date of hearing on maintainability

The Allahabad High Court on Monday fixed September 28 as the next date of hearing in a case pertaining to a petition filed by Anjuman Intezamia Masjid of Varanasi challenging the maintainability of an original suit filed in 1991 in the Varanasi district court. The original suit has sought the restoration of the ancient Kashi Vishwanath temple at the site where the Gyanvapi mosque currently stands. The petitioners claimed in the suit that the mosque is a part of the temple. On August 30 this year, the high court had extended the interim stay till September 30 on a Varanasi court order directing the Archaeological Survey of India to conduct a physical survey at the Kashi Vishwanath temple-Gyanvapi mosque complex and further proceedings in this case. Lakhimpur violence accused Ankit Das gets bail on medical grounds

The Allahabad High Court on Friday granted short-term bail to Lakhimpur Kheri violence accused Ankit Das on medical grounds. Das is a friend of Union Minister Ajay Mishra's son Ashish Mishra, who is the prime accused in the case related to the violence on October 3 last year in which eight people, including four farmers, had died. According to the bail application filed by Das, he is suffering from pulmonary fibrosis, fatty liver, and diabetes. His condition is very serious and needs immediate medical treatment which is not available in the jail or district hospital, it said. Considering the circumstances, the justice D K Singh granted bail of 15 days to Das and directed him to surrender forthwith thereafter. Cowhide transport does not amount to contravention of UP cow act, says HC

The Allahabad High Court has observed that the transport of cowhide does not amount to the contravention of provisions of the UP Prevention of Cow Slaughter Act. The observation was made by Justice Mohammad Aslam On August 17 allowing a criminal revision application filed by Manjeet Tanwar against a November 11, 2021, order of the chief judicial magistrate, Agra, rejecting the release of a vehicle allegedly used to transport cowhide. On March 24, 2021, acting on information that a truckload of cowhide was being transported from Rajasthan's Dhaulpur to Agra, the police stopped the vehicle near Saiyan and seized it. The High Court held that since transportation of cowhide is not specifically prohibited under the UP Cow Slaughter Act, the special magistrate, Agra, has the jurisdiction to decide over the release of the vehicle in question. It directed the chief judicial magistrate, Agra, to pass appropriate order on the release application of the applicant within a month.
