Maliwal case: Delhi HC calls Bibhav Kumar's arrest a necessity as per law

The arrest of Arvind Kejriwal's close aide Bibhav Kumar in a case concerning alleged assault on AAP MP Swati Maliwal was "necessary" and police strictly followed the law while doing so, the Delhi High Court has said. The court, which on Friday dismissed Kumar's petition that claimed his arrest was illegal, said in its written judgment that there was no merit in his plea. Kumar, currently in judicial custody, allegedly assaulted Maliwal at Kejriwal's official residence on May 13. He was arrested by the Delhi Police on May 18. In his plea, Kumar had sought a direction to declare his arrest as illegal and in gross violation of the provisions of section 41A (notice of appearance before police officer) of the Code of Criminal Procedure (CrPC) and against the mandate of the law. 2020 Delhi riots: Court acquits six men accused of theft, arson charges

A court here has acquitted six men who were accused of committing arson, rioting and theft during the 2020 communal riots in northeast Delhi. Additional Sessions Judge Pulastya Pramachala was hearing the case against them. It was alleged that they looted, vandalised and torched a house in Shiv Vihar on February 25, 2020. Later, a complaint about a clinic being set ablaze was also clubbed with this case. In an order passed on Friday, the court observed that the prosecution had submitted the digital video recorder (DVR) as evidence against the accused. Delhi High Court transfers investigation into coaching centre deaths to CBI

The Delhi High Court on Friday transferred the probe into the drowning of three civil services aspirants at the basement of a coaching centre here from police to the CBI "to ensure the public has no doubt over the investigation". Criticising the police for arresting an SUV driver and blaming him for the incident, the high court said, "Mercifully, you have not challaned the rainwater for entering into the basement." "You would have said how dare the water enter the basement. You could have fined the water also, the way you arrested the SUV driver for driving his car there," it said. Delhi HC to rule on doctors' plea against Ramdev over Coronil claims Monday

The Delhi High Court will on Monday pronounce its order on a plea by several doctors' associations against Yoga guru Ramdev over his claim of 'Coronil' being a "cure" for COVID-19. The plea forms a part of a 2021 lawsuit by the doctors' associations against the Ramdev, his associate Acharya Balkrishna as well as Patanjali Ayurveda. Justice Anup Jairam Bhambhani had reserved the order on the issue on May 21 after hearing the parties. According to the lawsuit, Ramdev made "unsubstantiated claims" with respect to 'Coronil' being a cure for COVID-19, contrary to the licence granted to the drug for merely being an "immuno-booster". The Delhi High Court sought the city police's stand on Wednesday on the bail plea of former Jawaharlal Nehru University (JNU) student Umar Khalid in a UAPA case related to the alleged larger conspiracy behind the February 2020 riots here. A bench of Justices Suresh Kumar Kait and Girish Kathpalia issued a notice to the Delhi Police on the bail plea and asked the agency to file its reply. The court listed Khalid's bail plea for hearing on August 29, along with the bail pleas of other co-accused in the case, including student activist Sharjeel Imam. The court observed that the bail pleas of Imam and the other co-accused in the case were "set for hearing". Delhi HC quashes summons to Hero Group Chairman Pawan Munjal in DRI case

The Delhi High Court on Wednesday quashed a summons issued to Hero Motocorp chairman Pawan Kant Munjal in a case registered by the Directorate of Revenue Intelligence (DRI) relating to foreign currency. The high court passed the order on Munjal's plea seeking quashing and setting aside of a trial court's July 1, 2023 order by which the summons was issued against him for alleged offences under the Customs Act. "The petition is allowed. Summoning order is quashed," Justice Manoj Kumar Ohri said while pronouncing the order. In November last year, the high court had stayed the proceedings relating to foreign currency lodged against Munjal by the DRI. The high court, in its interim order, had noted that Munjal was exonerated by the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) on the same set of facts and this was not disclosed before the trial court and that the petitioner had successfully made out a case for interim protection. The Delhi High Court on Monday pointed out several mistakes in AAP leader Somnath Bharti's petition challenging BJP MP Bansuri Swaraj's election in the 2024 Lok Sabha polls on grounds of alleged corrupt practices, and asked him to file a corrected one. Justice Manmeet PS Arora said at the outset that there were a lot of typographical errors which made it difficult to understand the averments in the petition. Even the reference to respondents in the petition did not correlate with the respondents mentioned in the memo of parties and synopsis, the counsel said. The court gave Bharti 10 days to file a corrected petition and listed the matter for further hearing on August 14. When Bharti's counsel urged the court to issue notice to the respondents on the petition, the judge said, "There are too many mistakes. Correct the petition first. I can't issue notice like this. A Delhi court on Friday reserved its order on whether to frame charges against Congress leader Jagdish Tytler in an anti-Sikh riots case in which three people were killed. Special judge for Central Bureau of Investigation (CBI) cases Rakesh Siyal reserved the order after hearing arguments by the counsel for the central probe agency and the defence.
