PILs increasingly used to target infrastructure projects, says SC

Public interest litigation (PIL) matters are being increasingly used to target infrastructure projects, the Supreme Court observed on Friday while refusing to entertain a plea challenging the re-development of a plot of land in Mumbai. "The PILs could become an instrument of blackmail when it is an issue of an infrastructure project. This actually makes a plank to target such projects. The (Bombay) High Court has actually smelled the rat here. This is happening across Delhi, Mumbai....," a bench of Chief Justice D Y Chandrachud and Justice P S Narasimha said. SC seeks Centre, states reply on PIL for free sanitary pads in govt schools

The Supreme Court on Monday sought responses from the Centre, states and Union territories (UTs) on a PIL seeking issuance of directions for providing free sanitary pads to girls studying in classes 6 to 12 in government schools across the country. A bench comprising Chief Justice D Y Chandrachud and Justice P S Narasimha took note of the plea of social activist Jaya Thakur, a Madhya Pradesh-based doctor, and issued notices to the central government and all the states and UTs. The top court also sought assistance of Solicitor General Tushar Mehta in the matter, saying the petitioner has raised the important issue of sanitation and hygiene of girl students in government and government-aided schools.

SC refuses to entertain PIL on putting up draft laws in public domain

The Supreme Court on Tuesday refused to entertain a PIL seeking directions to the Centre and the states to publish draft laws prominently on government websites and in the public domain at least 60 days before they are introduced in Parliament and state assemblies. A bench of Chief Justice U U Lalit and Justice Bela M Trivedi, however, hoped that the governments would put the laws in public domain in local languages so that citizens know about the legislations made for them. With regard to the pleas seeking a direction to put future laws in public domain, the bench said, It would not be proper on our part to direct the government to publish draft legislations. It is entirely left up to the government to take such decisions. As regards to the second prayer, we do believe that people must know the legislations made for them and such legislations must be provided in public domain in local languages. Delhi HC to hear PIL against political persons holding govt posts on Friday

The Delhi High Court will hear on Friday a public interest litigation (PIL) matter objecting to the appointment of persons holding important positions in political parties as public servants at various government posts. The petition, filed by lawyer Sonali Tiwary, says the "principle of political neutrality of public servants" prohibits them from taking part in political activities but there is "non-conformance to the above principle", which is not only causing huge losses to the public exchequer, but also propagating the beliefs of the political parties. The Bombay High Court has issued notices to the Union and Maharashtra governments seeking their response to a petition against an amendment to the Goods and Services Tax (GST) Rules by which GST registration can be suspended without giving the affected party a hearing. A division bench of Justices K R Shriram and A S Doctor, on August 29, issued notice to the Attorney General of India and Advocate General of Maharashtra as the plea challenges the validity of a provision of law. The order was made available on Monday. The court was hearing a petition filed by SAT Industries Limited challenging a show cause notice issued to it in August 2022 for cancellation of its GST registration.
