The Madras High Court made it clear that candidates cannot get a medical seat in Tamil Nadu under reserved category on the basis of a community certificate obtained from any other state.
Justice S Vaidyanathan dismissed a petition by S Geetha, belonging to the Schedule Caste, seeking direction of the court to the Directorate of Medical Education, Tamil Nadu, to consider a seat under the reserved category for her on the basis of a community certificate issued in Andhra Pradesh
The judge referred to an apex court order saying a Scheduled Caste/Tribe person who has migrated from the state of origin to some other state for education, employment etc. would be deemed to be a Scheduled Caste/Tribe of the state of origin and would be entitled to derive benefits from that state and not from the state to which he or she has migrated.
Dismissing the petition, the judge said, "However, her candidature can be considered only under the open category and not under the reserved category.
