HC quashes closure notice sent to Hauz Khas eatery

The Delhi High Court has quashed a closure notice issued to an eatery in the popular Hauz Khas village in south Delhi.

Justice A K Chawla observed that no hearing was given to M/S My Bar Grill before issuance of the revocation-cum-closure notice to the restaurant by South Delhi Municipal Corporation.

"Suffice to say, that no person can be put to harm without following the rule..., which is a well settled proposition of the law. The revocation-cum-closure notice therefore, cannot be sustained on this ground itself and is quashed," the court said.

The south MCD had issued the revocation-cum-closure notice on August 17 on the ground that during the inspection on August 16 of the premises by the area health inspector, the restaurant was found running the eating house with more than 48 seats and under most insanitary and unhygienic condition which was a serious violation of the terms and conditions of the health trade licence.
 

The restaurant in their petition filed through advocates Prashant Kumar Umrao and Adarsh Rai contended that they were not given an opportunity to respond to the notice, which was a violation of the principles of natural justice.
