The Madras High Court today said it would pass orders day after tomorrow on who has to investigate the matter relating to alleged torture of a woman by police in Udumalaipet in Coimbatore district.
Justice V Ramasubramanian opined that the remand magistrate and the Magistrate before whom the complaints were made had not acted in a manner known to law and did not do their duty perfectly.
He stated this after the medical report of the nodal officer of the Multi Speciality hospital at Omandurar Estate here was filed in a sealed cover and after arguments of Additional Advocate General Arvind Pandiyan and the petitioner's counsel
The judge opined that the magistrate, who ordered remand, may have acted on the day the woman was produced before him and the magistrate before whom the complaints were made on the alleged torture would have acted upon it without returning the complaints made to him.
The judge then declared that he would pass orders day after tomorrow on whether the investigation has to be transferred to any other agency and whether the woman prisoner has to get psychological treatment.
On September 10, the High Court had directed the nodal officer of the Hospital, who discharged the woman prisoner without any court order, to submit all medical reports and the case sheet in a sealed cover to the court by September 15.
Justice Ramasubramanian had also directed the officer to file another report stating whether the patient needs continuous treatment in that hospital or anywhere else and if so what kind of treatment is necessary, with the case sheet, medical reports, and the treatment administered to her together with the assessment of psychiatrist.
The judge had again stressed that no other person except her sister should be be allowed to visit her till further orders.
The court had on September 5 directed prison and police authorities to immediately admit the woman to the multi-speciality hospital at Omandurar Estate here.
The judge had also directed that no person from the police department, except the escort provided for the victim by armed reserve personnel, shall be permitted to meet her until further orders.
The woman was arrested in connection with a case of alleged murder and was reportedly tortured by Udumalaipet police.
