The Enforcement Directorate (ED) on Thursday opposed in the Supreme Court the grant of interim bail to Delhi Chief Minister Arvind Kejriwal in a money-laundering case linked to the alleged excise policy scam, saying the right to campaign in elections is neither fundamental nor constitutional. In a fresh affidavit filed in the top court, the ED said no political leader has ever been granted interim bail for campaigning even if he is not contesting polls. "It is relevant to note that the right to campaign for an election is neither a fundamental right nor a constitutional right and not even a legal right," the agency said. It added that to its knowledge, "no political leader has been granted interim bail for campaigning even though he is not the contesting candidate. Even a contesting candidate is not granted interim bail if he is in custody for his own campaigning". On Wednesday, Justice Sanjiv Khanna, who headed the bench that heard Kejriwal's petition against his arrest in the case

Delhi Minister Atishi on Wednesday said the public will vote to "end dictatorship and atrocities of the BJP" and to get their Chief Minister Arvind Kejriwal out of jail on May 25. Atishi, along with AAP and INDIA bloc candidate from the South Delhi Lok Sabha seat Sahiram Pehalwan, led a 'pad yatra' (foot march) in Govindpuri, Kalkaji, as part of the 'Jail ka Jawab Vote se' campaign. During the march, Atishi said the BJP has forgotten that Kejriwal is not just the chief minister, "he is the son and brother of the people of Delhi." Atishi asserted the BJP has made a "huge mistake" by arresting Delhi's "popular chief minister". Modi ji has arrested one Kejriwal, but today thousands of Kejriwals have come out from every street and 'mohallas' (locality) of Delhi to give a befitting reply. By arresting Shri Arvind Kejriwal, they have written 'the end' of their own dictatorship. On May 25, the public will vote to end the dictatorship and atrocities of the BJP, to get their brother, their
The Delhi High Court on Wednesday dismissed with Rs 1 lakh costs a public interest litigation by a lawyer seeking appropriate arrangements for Chief Minister Arvind Kejriwal to run the government from jail. The petitioner also sought to restrain Delhi BJP president Virendra Sachdeva from exerting any "undue pressure" for resignation of Kejriwal. A bench headed by Acting Chief Justice Manmohan observed that since the AAP leader has already approached the Supreme Court against his arrest, "no orders were called for" with regard to providing him any facilities while in judicial custody. The bench, also comprising Justice Manmeet PS Arora, further said the court cannot impose censorship on the media or stop political rivals from making statements. "Do we impose emergency? We impose censorship? We impose martial law? How do we gag the press? The political rivals?" the court said. "Keep bank draft of Rs 1 lakh ready," the court told the petitioner. The petitioner argued that although i

The Supreme Court said on Tuesday it doesn't want Delhi Chief Minister Arvind Kejriwal to discharge his official duties if he is released on interim bail in the money laundering case linked to the alleged excise policy scam as it would lead to a conflict of interest. The Aam Aadmi Party (AAP) leader was arrested on March 21 and is currently lodged in Tihar Jail under judicial custody. A bench of Justices Sanjiv Khanna and Dipankar Datta, which reserved its verdict on the question of interim bail, said allowing Kejriwal to attend his office may have a "cascading effect". "Suppose we grant you interim bail on account of elections. Then if you say you will attend office, it may have a cascading effect. If we give you interim bail, we don't want you to perform official duties as somewhere it will

Addressing a press conference, party leader Atishi alleged that Union Home Minister Shah in an interview with a news channel made it clear that the Enforcement Directorate intended to arrest Kejriwal from the very first time it sent him a summons. "Since the day Kejriwal started getting ED summons, AAP openly said that this was a conspiracy to arrest him," Atishi said. The Delhi minister said these were not ED, but "BJP summonses." "Even then BJP spokespersons used to say that ED is an independent investigation agency and they have nothing to do with the summons," she said.
