Sub-classification of SCs for quota: SC to consider in chambers review

The Supreme Court is scheduled to consider in-chambers on Tuesday a batch of pleas seeking review of its judgement which held that states are constitutionally empowered to make sub-classifications within the Scheduled Castes, which form a socially heterogeneous class, for granting reservation. As per the cause list, a seven-judge Constitution bench comprising Chief Justice D Y Chandrachud and Justices B R Gavai, Vikram Nath, Bela Trivedi, Pankaj Mithal, Manoj Misra and Satish Chandra Sharma is likely to take up the matter at 1.35 pm. On August 1, the top court had held that states are constitutionally empowered to make sub-classifications within the Scheduled Castes, which form a socially heterogeneous class, for granting reservation for the uplift of castes that are socially and educationally more backward. Row over OBC list: WB seeks early hearing of its plea against HC verdict

The West Bengal government on Tuesday sought an urgent hearing on its plea in the Supreme Court against a Calcutta High Court verdict striking down the OBC status of several castes, mostly Muslim groups, for granting reservation to them in public sector jobs and state-run educational institutions. The top court bench headed by Chief Justice D Y Chandrachud was told by senior advocate Kapil Sibal, appearing for the Trinamool Congress-led state government, that the plea along with other petitions needed to be heard as the issues like issuance of OBC certificate is stalled. The senior counsel said the authorities are unable to issue caste certificates to those seeking quota benefits in admissions, including entry to medical colleges. He said though the cases are listed for hearing in the day's list but they are unlikely to reach. Union Minister Amit Shah on Monday launched a scathing attack on the Congress, calling it an "anti-Dalit" party and said it "insulted" Dalit leaders like Kumari Selja and Ashok Tanwar. Shah also lashed out at Congress leader Rahul Gandhi for his remarks on reservation and asserted that if there is anybody who can protect the quota, it is Prime Minister Narendra Modi. BSP chief Mayawati on Friday attacked the BJP and the INDIA bloc, alleging that while the ruling party has adopted an anti-SC/ST stance over the issue of sub-classification and identifying creamy layer for reservation within the communities, the opposition coalition's silence on the matter is proving to be "fatal". Earlier this month, a seven-judge bench of the Supreme Court led by Chief Justice D Y Chandrachud ruled in a 6:1 majority judgement that state governments were permitted to sub-classify communities within the SC list based on empirical data. Union minister Ramdas Athawale has said his Republican Party of India (A) supports conducting a caste census in the country and believes some way should be found for it. The Congress on Sunday asserted that a caste census is the only way to ensure equal opportunity for all in the country. Govt forms panel to examine steps to safeguard interests of SCs: Report

A high-level panel has been formed to examine the administrative steps that can be taken to safeguard the interests of scheduled caste communities like the Madigas, sources said on Friday. The panel will seek to ensure fair allocation of benefits to the most disadvantaged communities within the Scheduled Castes, which have been overshadowed by comparatively affluent and influential groups. "On the directions of the prime minister, a committee of secretaries has been constituted under the chairmanship of cabinet secretary," a source privy to the matter said. SC notice to Centre, states on PIL alleging caste discrimination in jails

The Supreme Court on Wednesday sought responses from the Centre and 11 states, including Uttar Pradesh and West Bengal, on a PIL alleging that the prison manuals of these states encourage caste-based discrimination. Bihar urges Centre for 65% quota in 9th Schedule to seek legal shield

The Bihar government on Wednesday decided to urge the Centre to incorporate the hiked reservation for deprived castes from 50 to 65 per cent in state government jobs and educational institutions in the 9th schedule of the Constitution, so that it is guaranteed immunity from legal scrutiny, an official said. The Ninth Schedule of the Constitution includes a list of Central and state laws that cannot be challenged in courts. In 1992, the Supreme Court capped reservations for the backward classes at 50 per cent. The Cabinet also increased the dearness allowance of government employees in Bihar by 4 per cent.
