CBI probe initiated against Rahul Gandhi citizenship issue, Delhi HC told

The Delhi High Court was informed on Wednesday that a CBI probe had been initiated into Congress leader Rahul Gandhi's citizenship on a PIL being heard by the Allahabad High Court . When the petitioner, a Karnataka BJP worker, said he had moved a PIL in the Allahabad High Court, a bench of Chief Justice Manmohan and Justice Tushar Rao Gedela said it didn't want any conflicting orders to be passed. There cannot be two parallel petitions on the same cause of action, said the bench, permitting S Vignesh Shishir to file an affidavit on the relevant developments following his PIL in the Allahabad High Court. The Delhi High Court said decisions of a person holding a certain position may be harsh and impact an employee but they cannot be held liable for abetting a staffer's suicide in the absence of criminal intent. Justice Amit Sharma's observation came while quashing a trial court order summoning the former principal of B R Ambedkar College of Delhi University and a senior assistant working in the principal's office in a 2013 case of abetment to suicide of a woman staffer of the college. "A person holding a certain post, whether in a private sector or a public sector, in the course of duties has to take certain decisions which at times can be harsh causing hardship to an employee," the judge wrote in his October 29 order. Delhi HC asks AAP govt to respond to BJP MLAs plea for CAG reports

The Delhi High Court on Tuesday sought a response of the AAP government on a plea filed by several BJP MLAs seeking a direction to place 12 CAG reports related to liquor duty, pollution and finance before the assembly. The Delhi High Court on Tuesday granted bail to two accused -- Vaibhav Jain and Ankush Jain -- in a case of alleged money laundering involving senior AAP leader Satyendar Jain. Justice Manoj Kumar Ohri granted regular bail to the duo nearly 10 days after the former Delhi minister was granted relief. A court had granted bail to Satyendar Jain, who was arrested by the Enforcement Directorate (ED) in May 2022, citing "delay in trial" and his "long incarceration". The case pertains to allegations against Satyendar Jain of having laundered money through four companies allegedly linked to him. The Enforcement Directorate (ED) has claimed that Vaibhav Jain and Ankush Jain were business associates of the former Delhi minister and abetted the commission of the offence. The Delhi High Court on Monday agreed to list for October 29 a plea by BJP MLAs seeking a direction to the city government to send 12 CAG reports on liquor duty, pollution and finance to the lieutenant governor for placing those before the assembly. The petition was mentioned for listing by a senior counsel appearing for the petitioners before a bench headed by Chief Justice Manmohan. "Tomorrow," the bench, also comprising Justice Tushar Rao Gedela, said. Delhi riots case: Expeditiously hear Sharjeel Imam bail plea, says SC

The Supreme Court on Friday told the Delhi High Court to expeditiously hear the bail plea of student activist Sharjeel Imam in an Unlawful Activities Prevention Act (UAPA) case related to Delhi riots which took place in February 2020. A bench of Justices Bela M Trivedi and S C Sharma said it was not inclined to entertain the plea, which also sought bail under Article 32 of the Constitution. Imam's counsel, senior advocate Siddharth Dave, said the bail plea had been pending since 2022 while clarifying he was not pressing for bail at the present stage. The top court noted the high court would be hearing the case on November 25. "This being the writ petition filed under Article 32 of the constitution, we are not inclined to entertain the same. However, petitioner shall be at liberty to request the high court to hear the bail application as expeditiously as possible preferably on November 25, as fixed by the high court. The high court shall consider the said request," held the bench.

Delhi HC asks govt's response over resale of tickets, blocking sites

The Delhi High Court on Thursday sought the response of the Centre on a plea seeking a regulatory framework to regulate the resale of concert tickets through authorised platforms and avoid illegal selling activities. A bench of Chief Justice Manmohan and Justice Tushar Rao Gedela issued notice to Union ministries of Information and Broadcasting and Electronics, and Information Technology, private entities Stubhub Inc, Viagogo Entertainment Inc and Bigtree Entertainment Pvt Ltd on the petition. The court said the replies would have to be filed within four weeks and posted the hearing on February 18, 2025, when a similar petition would be heard. The petition further sought a direction to the Centre to block unlawful online platforms involved in the purported illegal and unauthorised sale of tickets in India. The Delhi High Court has said campuses at the Delhi University were yet to recover from student unions' "election excesses" and looked "shabby" as posters and graffiti hadn't been removed as it directed the candidates to clean up the place and repaint the defaced walls. Delhi HC closes plea to permit activist Sonam Wangchuk, others to protest

The Delhi High Court on Tuesday closed the proceedings on a plea seeking permission for climate activist Sonam Wangchuk and others to hold a peaceful protest at Jantar Mantar here. Petitioner Apex Body Leh's counsel said they no longer wished to press the plea as the protest stood withdrawn following a discussion with the authorities. Solicitor General Tushar Mehta, who was representing Delhi Police, added that Wangchuk has also withdrawn his fast and, therefore, the petition might not survive. Coal scam: Delhi HC dismisses Madhu Koda's plea seeking stay on conviction

The Delhi High Court on Friday rejected a plea by former Jharkhand chief minister Madhu Koda seeking to stay his conviction in a coal scam case. Koda had sought a stay on his conviction to enable him to contest upcoming assembly elections in the state. "Application dismissed," said Justice Neena Bansal Krishna. Koda, former coal secretary H C Gupta, former Jharkhand chief secretary A K Basu, and Koda's close aide Vijay Joshi were awarded three-year jail terms by a trial court for indulging in corrupt practices and hatching a criminal conspiracy in the allocation of Rajhara North Coal Block in the state to Kolkata-based company, Vini Iron and Steel Udyog Ltd (VISUL). It had also imposed fines of Rs 50 lakh, Rs 25 lakh and Rs 1 lakh on VISUL, Koda and Gupta respectively in the UPA-era coal scam. A Rs 1 lakh fine was also imposed on Basu. The convicts were granted bail during the pendency of their appeals.
