NGO APCR moves SC challenging constitutional validity of Waqf Bill

An NGO has moved the Supreme Court challenging the constitutional validity of the Waqf (Amendment) Bill, 2025. Association for the Protection of Civil Rights said its plea challenges the constitutionality of the Waqf (Amendment) Bill, 2025, which is to be renamed as the Unified Waqf Management Empowerment, Efficiency, and Development Bill, 2025 (UMEED Bill). "The bill directly violates Articles 14, 25, 26, and 300A of the Constitution, along with the preambular values that constitute the bedrock of our democratic and secular framework," it said in its plea filed through Adeel Ahmed. It said the drastic overhaul proposed by the UMEED Bill is not only unnecessary but also an alarming interference into the religious affairs of the Muslim community, diluting the fundamental purpose of Waqf which is a practice deeply rooted in Quranic references and the Hadith since the time of Prophet Mohammad. Aam Aadmi Party MLA Amanatullah Khan has moved the Supreme Court, challenging the constitutional validity of the Waqf (Amendment) Bill, 2025. In his plea, Khan sought that the Waqf (Amendment) Bill be declared as "unconstitutional and being violative of Articles 14, 15, 21, 25, 26, 29, 30 and 300-A of the Constitution" and sought direction for striking it down. "The Bill violates fundamental rights enshrined under Articles 14, 15, 21, 25, 26, 29, 30, and 300-A of the Constitution. It curtails the religious and cultural autonomy of Muslims, enables arbitrary executive interference, and undermines minority rights to manage their religious and charitable institutions," Khan's plea said. Uttar Pradesh Chief Minister Yogi Adityanath on Thursday launched a scathing attack on the Waqf Board, accusing it of land encroachments and asserting that its "arbitrary claims" over public and historical sites would no longer be tolerated. Speaking at a gathering in Prayagraj, Adityanath said, "The Waqf Board had been making baseless claims over lands across cities. Even during the preparations for the Kumbh Mela, they declared that the event's land belonged to them. We had to ask - ?has the Waqf Board turned into a land mafia?" He emphasised that under his government, such encroachments had been removed, and mafias had been driven out of Uttar Pradesh. "Encroachments were made in the name of Waqf at various places, including the sacred land associated with Nishad Raj. But this will not be allowed to continue. Waqf Amendment Bill will aid underprivileged Muslims, says AIMJ chief

The national president of All-India Muslim Jamaat, Maulana Shahabuddin Razvi Barelvi, on Thursday welcomed the passage of the Waqf (Amendment) Bill, 2025, in the Lok Sabha, expressing hope that it will bring significant economic relief to the underprivileged Muslims. "I extend my gratitude to all the Lok Sabha members who voted in favour of the Bill, and congratulate the government of India for taking this commendable step," Razvi said in a statement. He also said the proposed amendments would curb the alleged irregularities in Waqf properties, which, according to him, were previously being misused by vested interests in collusion with land mafias.
