The BJP Thursday told Lt. Governor Najeeb Jung that it cannot form a government in Delhi as it lacked majority support in the hung 70-member legislature.
Chief ministerial candidate Harsh Vardhan said the Bharatiya Janata Party would prefer to occupy the opposition benches.
The BJP, which won 31 seats followed by the Aam Aadmi Party's 28 from the Dec 4 election, should not be held responsible if this leads to a fresh election, he said.
