A youth accused of raping and beating his lover has been acquitted by a Delhi court which said the girl "turned hostile" during her deposition.
Additional sessions judge Yogesh Khanna freed the Bihar resident at the stage of recording of prosecution evidence as the girl in her statement did not mention about rape or beating by the accused.
"The prosecutrix (girl) had not alleged rape or beating against the accused, so further trial of this case would have been a futile exercise and hence, I closed the evidence of prosecution.
"Considering the facts and circumstances, as the girl had turned hostile and does not support the case of prosecution so it can be safely said that the prosecution had failed to prove its case against the accused beyond reasonable doubt and hence he stands acquitted of the charges framed against him," the judge said.
The youth was facing trial before a fast-track court here on the complaint lodged by the girl, who had alleged that she was beaten and raped by her lover on March 11, after she had resisted his sexual advances before their marriage.
The girl, a resident of West Bengal, in her complaint had said she met the accused in 2010 at Sihaldha railway station there and had exchanged their telephone numbers.
"The accused told me that he is residing in Delhi for the last 7-8 years. After I came to Delhi, I started residing with one of my friends. After sometime we started meeting each other and we fell in love," the girl had said.
She had further alleged that the youth took her to his friend's house and maintained physical relations and he had given in writing that he would marry her.
