The Madras High Court today dismissed as infructuous four petitions filed by the then chief minister J Jayalalithaa, her associate V K Sasikala and a firm
in 2004 seeking to quash Income Tax proceedings against them in a lower court in view of the department withdrawing them in 2015.
Justice M Nirmal Kumar noted that the Additional Chief Metropolitan Magistrate Court (economic offences) had allowed a plea by the department's Special Public Prosecutor seeking withdrawal of action against the petitioners after acceptance of compounding pleas filed by the petitioners.
The matter related to the prosecution initiated by the I-T Department in 1997 against Jayalalithaa and Sasikala and Sasi Enterprises in which they were partners over filing of income tax returns for 1993-94.
The proceedings were withdrawn by the department in January, 2015 after Jayalalithaa and Sasikala together paid Rs 1.99 crore as compounding fee under the Income Tax Act for not filing annual tax returns.
Jayalalithaa had died on December 5, 2016.
