The Madras High Court Bench here today set aside a single judge's order granting permission to DMK to stage a protest in front of the city Corporation office on the ground that it was a busy area.

A bench, comprising Justices R.Sudhakar and V.M.Velumani, passed the order while upholding the order of the Assistant Commissioner of Police rejecting permission for the demonstration in a busy area.

The protest demonstration was to be staged against alleged mismanagement of the AIADMK-ruled civic body, bad roads and unhygienic conditions in this city.

The single judge had on October 14 allowed a plea by DMK and granted permission for the protest.

Setting aside the order, the division bench suggested that DMK could apply for holding the demonstration in any of the 16 select locations suggested by the police and directed the police to give immediate permission for the same with usual conditions.

Earlier, Tamil Nadu Advocate General A L Somayaji wondered why DMK was insisting on holding demonstration only in front of the Corporation building, situated on a busy road, and not in any other location.

He contended that acceding to such requests might lead to a situation when litigants would seek permission to hold demonstration even in front of the high court.
