Imposing onerous c'tion to release person equal to bail denial

:Stating that imposing onerous condition to release a person on bail was equal to denying bail, Madras High Court bench today deleted the condition to deposit Rs 50 lakh for release of a petitioner against whom a criminal case was registered by Ramanathapuram District Crime Record Bureau.

Allowing a criminal original Petition filed by the petitioner Mohan, Justice C T Selvam said "What the court below in effect has done is that it has plucked with one hand that which has been granted through anoter hand."Imposition of Onerous condition would amount to negation of the relief granted."

The Petitioner sought to set aside the order of the Additional Sessions judge of Madurai, who had directed Mohan to deposit Rs 50 lakh as precondition for enlarging him on bail
 

The judge deleted the condition to pay the money.
