Jodhpur's engineering college asked to pay over Rs 3 lakh to

A Jodhpur-based engineering college has been directed by the apex consumer commission to pay over Rs three lakh to one of its students for rejecting his admission on the ground that he failed in the previous exams despite having charged him for the current session.

National Consumer Disputes Redressal Commission (NCDRC), presided by Justice K S Chaudhary, asked Marwar Engineering College and Research Centre to pay Rs 3,09,250 to Jodhpur resident Hanwant Singh.

The order was passed by the NCDRC while dismissing the college's plea for condonation of delay of 347 days in filing an appeal against the verdict of Rajasthan State Consumer Disputes Redressal Commission.
 

The state commission had earlier upheld a district consumer forum's order which had asked the college to pay the money.

"...There is no reasonable explanation at all for the condonation of inordinate delay of 347 days. In such circumstances, application for condonation of delay is liable to be dismissed.

"As the application is to be dismissed, revision petition being barred by limitation is also liable to be dismissed," the NCDRC said.

Singh, who was pursuing Bachelor of Engineering, told the court that he was admitted in the next semester even before the declaration of the result of his previous semester's exams. The college had also taken the fee of the next semester.

He claimed that in 2008, he was informed that he was not entitled to appear in the third semester because he did not pass a few papers of first year.

Aggrieved by this, Singh filed complaint before a district consumer forum, alleging deficiency on the part of college.

The district forum had asked college to pay Rs 3,09,250 to Singh. After the state commission upheld district forum's order, the college moved NCDRC.
