A suspected Maoist couple and three of their associates, who were arrested in Coimbatore in May this year, have moved the Madras High Court challenging their subsequent detention under National Security Act, saying they have been falsely implicated.
"The so-called terrorist activities (by the arrested) were a brainchild of the sponsoring authority (police) to elevate the case to an act affecting public order," key accused Roopesh's wife Shyna told the court in a habeas corpus petition.
A division bench, comprising Justice S Tamilvanan and Justice C T Selvam before which the petition came up for admission today, issued notices to central and state governments, returnable by October 12.

According to Shyna, she and others were detained while they were sitting in R C Bakery at Karumathampatti in Coimbatore. No overt act had been attributed to them, except the fact that they were found talking to each other.
Shyna said their arrest itself was illegal because they were not informed of the grounds of arrest and no one close to them was informed of their detention.
She said her right to pursue her own political ideology was violated by police. The grounds of arrest and detention were vague and there was no reason to detain them under NSA, she said.
