The Delhi High Court has clarified that all legal services provided by advocates and law firms are to be governed by the reverse charge mechanism under GST till further orders by the court. The bench of Justices S Muralidhar and Pratibha M Singh passed the directions on a petition by J K Mittal, owner of J K Mittal and Company, a law firm providing a variety of legal services and representing clients in various courts and tribunals across the country. Mittal had approached the court highlighting concerns over notifications made by the Central government and the Government of the National Capital Territory of Delhi (GNCTD) in June 2017, which he claimed were in violation of the Central Goods and Services Tax (CGST) Act and the Delhi Goods and Services Tax (DGST) Act and Article 276A of the Constitution. Central Board of Excise and Customs (CBEC) chairperson Vanaja Sarna said concern over the new goods and services tax (GST) raised by the textiles and entertainment sectors were being looked into and will get settled with time.However, the already fixed rates would not be revised, unless there were anomalies or genuine mistakes in fixing these. On Tuesday, finance minister Arun Jaitley had also ruled out any revising of GST rates for the textiles sector. "Unless there is something not fully justified...unless there is an anomaly, I don't think there is a reason to look at any rates at the moment," Sarna said on Wednesday.
