The Allahabad High Court on Friday declared the appointment of senior IPS officer Ashutosh Pandey as the head of the Uttar Pradesh Directorate of Prosecution as illegal and without authority of law. The court said the appointment was contrary to statutory provisions of the Code of Criminal Procedure (CrPC), which states that a person holding this post must be in practice as an advocate for not less than 10 years and such an appointment should be made with the concurrence of the chief justice of the state's high court. Besides, the court also directed the state government to ensure the appointment of a new director of prosecution within six month's time. Karnataka Director General of Police Praveen Sood has been appointed as the next director of the Central Bureau of Investigation, a government order said on Sunday. Sood is a 1986-batch Indian Police Service (IPS) officer of the Karnataka cadre, officials said. He has been appointed to the CBI director's post for a period of two years from the date of taking charge after Subodh Kumar Jaiswal completes his tenure on May 25, they said. In the order, the Department of Personnel and Training said, "Approval of the competent authority is hereby conveyed to the appointment of Praveen Sood, IPS (KN:86) as Director, Central Bureau of Investigation (CBI) for a period of two years from the date of assumption of charge of the office vice Subodh Kumar Jaiswal, IPS (MH:85) consequent upon completion of his tenure.
The Supreme Court on Wednesday dismissed a plea by sacked IPS officer Sanjiv Bhatt to submit additional evidence to support his appeal in the Gujarat High Court against his conviction in a 1990 custodial death case. Earlier in the day, the top court also rejected Bhatt's plea seeking recusal of Justice M R Shah from hearing the matter. Bhatt's lawyer on Tuesday contended that there was a reasonable apprehension of bias as Justice Shah as a high court judge had castigated the petitioner while hearing his plea linked to the same FIR. However, it was opposed by the counsel for the Gujarat government and the complainant who called it "forum shopping" and asked why he had not objected earlier. An apex court bench of Justices M R Shah and CT Ravikumar said it was not inclined to interfere with the high court order. The Gujarat government on Monday transferred 15 Indian Police Service (IPS) officers and allotted postings to two other senior cops waiting for new assignments, a top level reshuffle carried out ahead of Assembly elections due in the next few months. The state home department transferred 15 IPS officers and promoted officer Neeraj Badgujar, who was waiting for a new posting, and appointed him Additional Commissioner of Police (ACP) (sector-1), Ahmedabad city, as per a notification. Manoj Ninama, another officer waiting for a new assignment, was appointed ACP (crime and traffic), Vadodara city, it said. Additional Director General of Police (ADGP) (Surat range) Rajkumar Pandian was transferred to Ahmedabad as ADGP (Railways), said the notification. He will also hold the additional charge of Executive Director of Gujarat Urja Vikas Nigam Ltd (GUVNL), a state-run power company, in Vadodara.
