A Muslim man serving a life sentence for his role in the 1993 bombing of the World Trade Center wants a judge to determine that federal prison officials violated his religious rights by failing to provide meals strictly conforming to his beliefs and access to an imam of the same denomination. The two-day civil case wrapped yesterday in a Denver federal courtroom. Judge R Brooke Jackson did not immediately rule and is expected to issue a decision in writing. Ahmad Ajaj was being held at a super-max prison in Colorado when the lawsuit began in 2015. Ajaj, represented by University of Denver law students, watched the trial via video because of security concerns. Ajaj was sentenced in 1999 to more than 114 years in prison for his role in the blast in an underground parking garage on February 26, 1993, that killed six people, one of them pregnant. It injured more than 1,000 and forced an estimated 50,000 to flee the trade center's twin towers in a scene of smoke, fear and confusion that ...

SC gives arrested activists a breather, says dissent is safety valve of democracy

The Maharashtra Police's move to arrest five well known activists was punctured today with the Supreme Court observing that "dissent is the safety valve of democracy" and directing that those in its custody be kept under house arrest. The five human rights activists -- Varavara Rao, Vernon Gonzalves, Arun Ferreira, Sudha Bharadwaj and Gautam Navlakha -- who were arrested after the pan India crackdown yesterday will not be sent to jail but be under house arrest until September 6, the court ruled. "Dissent is the safety valve of democracy and if you don't allow these safety valves it will burst," a bench headed by Chief Justice Dipak Misra and comprising Justices A M Khanwilkar and D Y Chandrachud said. Dealing a blow to the Maharashtra police, the apex court questioned it for arresting the activists nine months after the violence between Dalits and upper caste Peshwas in Koregaon-Bhima village near Pune following the Elgar Parishad, or conclave, on December 31 last year. Provocative ...

Dissent is 'safety valve' of democracy, says SC; Orders house arrest for 5 rights activists

Five human rights activists arrested in connection with the Bhima-Koregaon violence case would be kept under house arrest at their homes till September 6, the Supreme Court ordered today, observing that dissent was the "safety valve" of democracy. While granting relief to activists Varavara Rao, Arun Farreira, Vernon Gonzalves, Sudha Bhardwaj and Gautam Navalakha, the top court did not consider for now the vehement opposition of Maharastra government challenging the locus of the petitioners, historian Romila Thapar and four others, seeking relief on their behalf, and calling them "strangers". The Maharashtra police had arrested them in connection with an FIR lodged following a conclave -- 'Elgaar Parishad' -- held on December 31 last year that had later triggered violence at Koregaon-Bhima village. The state had challenged the petitioners' locus, dubbing them as "strangers". A bench headed by Chief Justice Dipak Misra questioned the state police's move to arrest these activists nine ..

Corruption trial of senior Kenyan judge suspended

The corruption trial of Kenya's deputy chief justice, the country's second-highest judge, was suspended today amid a barrage of legal petitions at various courts. Philomena Mwilu, one of seven members of the Supreme Court, was arrested yesterday after Kenya's director of public prosecutions, Noordin Haji, accused her of abusing her office for personal gain. Mwilu was among the judges who annulled President Uhuru Kenyatta's initial election win in August 2017, leading to the controversial holding of a fresh vote. She was due to be formally charged at a Nairobi magistrates' court today but High Court judge Chacha Mwita suspended the case until October 9 to hear a constitutional challenge brought by her lawyers. Mwilu's lead lawyer James Orengo, a prominent opposition figure and elected senator who played a key role in overturning last year's election result, said the move against her was "an attack on the judiciary". "These charges have been brought not to secure justice but to secure ..

HC directs release of Bhushan Steel ex-promoter Neeraj Singal on interim bail

The Delhi High Court today directed that Bhushan Steel's erstwhile promoter Neeraj Singal, arrested by the SFIO for allegedly siphoning off Rs 20 billion, be released on interim bail as the agency has not been able to justify the need for his continued incarceration. A bench of justices S Muralidhar and Vinod Goel said since Singal's challenge to the constitutional validity of the provisions for grant of bail and powers of arrest of SFIO were prima facie not frivolous, he should be able to seek interim relief. "Therefore, the present petition cannot be viewed as a mere plea for issuance of a writ of habeas corpus and an attempt to bypass the regular route of obtaining regular bail," the court said and added that he be released on interim bail subject to furnishing a personal bond of Rs five lakh and two sureties of Rs two lakh each. The Serious Fraud Investigation Office (SFIO) orally urged the court to stay operation of its order for a week, but the bench declined it. The matter took
