The Supreme Court today set aside an order of Calcutta High Court acquitting 32 CPI(M) workers in case of 1993 post Panchayat poll violence involving Left and Indian People's Front members in which five people were killed and over two dozen grievously injured. A bench of justices N V Ramana and M M Shantanagoudar set aside the June 30, 2004, order of the high court and remitted it back to decide the revision petition afresh on merit in accordance with law. It said that the High Court has failed to consider whether the trial court discarded material evidence in the form of eyewitness testimony on the issues of murder, attempt to murder and grievous hurt and completely overlooked evidence on other charges such as unlawful assembly and house-burning. "Consequently, we find that the High Court has not given due consideration to the evidence on record to arrive at a reasoned conclusion and has thus failed to exercise its revisional jurisdiction in accordance with established principles," ..

Decriminalisation of politics: EC, Centre at loggerheads in SC

The Election Commission and the Centre were at loggerheads in the Supreme Court today on the aspect of judicial intervention to ensure decriminalisation of politics. While the poll panel exhorted a five-judge constitution bench headed by Chief Justice Dipak Misra to issue directions on issues such as disqualification of lawmakers even before conviction, the Centre, through Attorney General K K Venugopal, asked the court to keep off. Senior advocate Meenakshi Arora, appearing for the poll panel, referred to the reports of the Election Commission and the Law Commission on decriminalisation of politics and said these were out way back in 1998 and 1999 respectively, but no action was taken by the government. "It is very clear that political parties are fielding candidates with criminal antecedents and the court should pass directions," the lawyer said, adding, "if Parliament is stonewalling this, then the court has to step in". The poll panel, in its report, had referred to section 8 of ..

One of the weapons probably used in the murder of rationalist Narendra Dabholkar five years ago was not destroyed by the alleged killers as they believed it was "lucky" for them, CBI sources said. The weapon could have also been used in the murder of other left leaning activists like Govind Pansare in February 2015, M M Kalburgi in August 2015, and Gauri Lankesh in September last year, they said, however, adding with caution that any conclusion can only be drawn after a confirmatory ballistic test of the firearm. The agency has recently arrested and questioned Aurangabad-resident Sachin Andure who is alleged to be one of the two shooters involved in the killing of Dabholkar on August 20, 2013, in Pune while on his morning walk, they said.
