Sufficient knowledge of Marathi must for lower court judges: Bombay HC

The Bombay High Court has ruled as "constitutional" the requirement for prospective subordinate court judges in the state to have sufficient knowledge of Marathi. A division bench of Justices R M Savant and Revati Mohite Dere, on August 24, had upheld the provisions of Rule 5(3)(d) of the Maharashtra Judicial Service Rules of 2008, which mandates that a candidate must have sufficient knowledge of Marathi so as to enable him or her to speak, read and write the language and translate from it to English and vice versa. The bench was hearing a petition filed by one Shobhit Gaur, who was shortlisted by the Maharashtra Public Service Commission (MPSC) for the post of Civil Judge Junior Division and Judicial Magistrate First Class, but was later rejected as he did not know Marathi. The victim had told the trial court that she was unable to see the face of the perpetrator as he had worn a mask. Her brothers had also said that they had not seen anyone at the crime spot. However, while filing a police complaint, the victim and her brothers had named the accused as well as identified him, which was corroborated by forensic evidences. On the basis of the medical report, a single bench of Justice J P Gupta observed that the victim had suffered injuries to her private parts. HC calls for revisiting inter-state arrest procedure to prevent 'lawlessness' by police

Instances of police from other states arresting people from the national capital without informing the local police has led the Delhi High Court to call for revisiting procedure for such actions to ensure life and liberty of citizens is not compromised by the "lawlessness" of the police force. A bench of Justices S Muralidhar and Vinod Goel said such practice was "contrary to the police manuals" and if allowed to go unchecked, would "amount to condoning the lawlessness by the police force". "In a country governed by the rule of law, this is simply unacceptable," the court said while referring to two incidents -- one of a young married couple being taken into custody from the Jawaharlal Nehru University here by a Uttar Pradesh police officer on a complaint by the woman's father and the other in which police officials from Gujarat arrested and took away a juvenile from here without informing the Delhi Police. Plea in HC to amend election rules on using same pen to cast vote

A plea has been filed in the Delhi High Court challenging the election rules under which only an instrument given by the Election Commission is to be used for marking ballots to cast vote. The petition, which contended that these provisions could be misused and should be amended, is likely to come up for hearing tomorrow before a bench of Chief Justice Rajendra Menon and Justice V K Rao. The petition filed by advocate Amit Sahni claimed that the Election Commission (EC) provides a common instrument or article, i.e. pen, to voters for marking ballot paper which could be easily replaced. Weightage is required to be given to the intention of the person casting vote and not on the instrument viz ink of pen, which could be replaced at the behest of any candidate, the plea sad. Citing an instance of "misuse" of such provisions of Conduct of Elections Rule 1961, he alleged that in the 2016 elections to Rajya Sabha in Haryana for two seats, the pen given by the EC was changed leading to ...

The National Green Tribunal has summoned secretaries of the Forest Department and the Urban Development of the Himachal Pradesh government to explain "unsatisfactory progress" in the Manali-Rohtang ropeway project. A bench headed by NGT Chairperson Justice Adradh Kumar Goel noted that despite its direction to expedite the work on "Palchan Rohtang" ropeway, forest clearance has not been granted to it. "We find it difficult to understand why forest clearance has not been granted in spite of directions of this tribunal. "It is further stated that the project will be completed within 48 months after the clearance is granted. In view of emergent situation as set out in the orders of this Tribunal dated February 6, 2014 and further orders mentioned in our last order dated July 17, 2018, such a long timeline seems to be unjustified and to defeat the purpose of the order of this tribunal," the bench said. The tribunal also noted that no strict timeline has been furnished with regard to ...
