The Supreme Court on Wednesday said that no one can be arrested without adoption of a fair procedure and that not even Parliament can make such a law, insisting that Article 21 of the Constitution on right to life and liberty has to be read in every provision of law having a bearing on the liberty of people.

The Narcotics Control Bureau (NCB) has arrested one person and seized a large quantity of heroin from his possession, a senior official said today. Acting on a tip-off, NCB sleuths intercepted a Hyderabad-bound bus in Manpur area here last night and arrested a 45-year-old man, the bureau's Indore Regional Director B R Meena said. Not disclosing the accused's name, Meena said search revealed that he was carrying 480 grams of heroin and 290 grams of another substance with him, both together worth Rs one crore in the international market. The latter substance appeared to be Alprazolam, an anti-anxiety drug which can be sold only with a doctor's prescription as it is known to be misused. It was sent to a forensic laboratory for tests, he said. A Bangladeshi national was found in possession of Aadhar and PAN cards when he was nabbed along with two of his countrymen for illegally staying here for the past over four years, police said today. Mohammed Yousuf, Masum Billa and Mohammed Babu (in the age group of 20-30), entered the country after illegally crossing the border, they said. With the help of others, they migrated to Hyderabad and were residing in a rented house, police said, adding, they were working as labourers. Yousuf obtained Aadhaar card by furnishing false information to the Unique Identification Authority of India (UIDAI) authorities, Balapur Police Station Inspector S Mohan Reddy said. Based on Aadhaar card, he procured PAN and Voter ID cards by submitting fabricated documents, the inspector said.
Police here today claimed to have busted an IPL betting racket with the arrest of seven persons who were caught with Rs seven lakh in cash and 10 mobile phones. The arrests took place during two raids conducted in Rupaspur police station area of the city, upon a tip-off that a group of anti-social elements there were involved in running an illegal betting racket, Senior Superintendent of Police, Patna, Manu Maharaj said. Naxals today disrupted the construction work for a culvert near a CRPF camp in Chhattisgarh's Bijapur district, located around 450 kms away from here, and killed a private firm employee, police said. The ultras also allegedly torched four vehicles and machines engaged in construction work at around 12 noon near Chinnakodepal camp of the CRPF under Modakpal police station limits where construction of a culvert was underway, a local police official told PTI. The Supreme Court today justified its March 20 verdict on the SC/ST Act, saying even Parliament cannot allow the arrest of a person without a fair procedure and asserted that it has protected the fundamental rights to life and liberty of innocents by ordering prior scrutiny of complaints. The Centre opposed the verdict saying that courts cannot order to supplant or substitute a provision in the law enacted by the Parliament. A bench of Justices Adarsh Goel and U U Lalit said, "we are not living in a civilised society, if we allow an innocent to go behind bar on a one-sided version". The bench deferred the hearing of the matter after the summer vacation and said it would hear all the parties concerned in detail. The police has foiled an abduction bid in Jammu city and arrested one of the three accused, officials said today. Last evening, the police received information that a man, identified as Rajinder Singh, had been abducted by three people from Shakti Nagar area, they said. Police swung into action and deployment was stepped up at various checkpoints in the area. The abductors fled seeing a police Gypsy approaching, leaving behind Singh and their vehicle, police said. One of the accused was arrested while fleeing and Singh was rescued, they added. A case has been registered and a hunt to nab the remaining two accused is underway.
Around 50 persons, including two corporators of the Aurangabad Municipal Corporation, have been arrested in connection with last week's violence in Aurangabad that claimed two lives and left over 60 people injured, a senior official said today. The two corporators - Rajendra Janjal of Shiv Sena and Feroz Khan of All India Majlis-e-Ittehad-ul Muslimeen (AIMIM) - were arrested by the Special Investigation Team (SIT) of Aurangabad police yesterday, the official said. Four persons were arrested with weapons and live cartridges for hatching a dacoity in Rajasthan's Pratapgarh district, police said today. Acting on a tip-off, police teams were sent to nab them. Out of five persons, four were arrested, Pratapgarh Superintendent of Police, Shivraj Meena said. He said that the accused, including Omprakash Jat (22), Devilal Jat (28), Rakesh Jat (20) and Rajuram Jat (18), were arrested with two pistols, 12 live cartridges, gas cutter, LPG cylinder. All the accused have a past criminal record and cases were registered against them in various police stations, he said.
A Haryana-based woman was apprehended at the Delhi airport today for allegedly carrying a live bullet round in her baggage, an official said today. R Vaid (26) was intercepted by a Central Industrial Security Force officer, who detected the bullets while scanning her baggage at the Indira Gandhi International Airport (IGIA) in the morning, he said. A bullet of .32-mm calibre was recovered from the passenger who was travelling to Amritsar from here, the official said. "The lady, who hailed from Karnal in Haryana, was not allowed to take the flight and was handed over to the police by the CISF authorities as she could not produce any documents for carrying the ammunition," he said.

The Justice (retd) Mehtab Singh Gill Commission, set up to look into "false cases" registered during the decade-long SAD-BJP regime, today submitted its seventh report to Punjab Chief Minister Amarinder Singh. The report recommended cancellation of 21 FIRs filed maliciously, while dismissing 158 frivolous complaints out of the total of 179 cases examined in this round, an official release said. Of the total 4,213 complaints received by it, the commission has so far dealt with 1,074, of which 746 have been dismissed, while action has been recommended on 328 complaints, it said. Besides cancellation of FIRs in 21 cases, the commission, in its interim report, has also recommended disciplinary action against the erring police officers/officials, including registration of FIRs against certain police officials, the release said. The commission has also recommended award of adequate monetary compensation to the accused (complainants before the commission) to be recovered from certain police .
