Fodder scam verdict: 37 accused sentenced; total fine Rs 29 crore

The sentences awarded today to 37 accused in a fodder scam case, with terms ranging from 3.5 years to 14 years, and fines amounting to over Rs 29 crore followed a 17-year-long trial, officials said. O P Diwakar, the then regional director of the Animal Husbandry Department, was sentenced to rigorous imprisonment of 14 years along with a fine of Rs 2 crore by a special court in Ranchi. He was sentenced to seven years' jail in two separate cases, which would run consecutively, and Rs one crore fine in each of them, the CBI spokesperson said. Besides him, 15 former officials were sentenced to seven years' rigorous imprisonment (3.5 years each in the two cases) and slapped with a fine of Rs one crore each (Rs 50 lakh in each of the two cases), with the sentences running consecutively. Three suppliers were sentenced in only one case with imprisonment of seven years and a fine of Rs one crore each, the spokesperson said here. The remaining 18 suppliers of fodder were sentenced to 3.5 years .

SIT arrests 3 policemen in connection with 'custodial death'

?A Special Investigation Team probing the alleged custodial death of a 26-year-old man at nearby Varappuzha today arrested three policemen, who were suspended earlier, in connection with the incident. "Three policemen, including Jithinraj, Sumesh and Santhosh have been arrested in connection with the incident. They were members of the Rural Tiger Force of Ernakulam rural police", Special Investigation Team (SIT) chief IGP S Sreejith said. He said their arrest was recorded after collecting necessary evidence in the primary investigation. "They have been charged under Section 302 of the Indian Penal Code" (punishment for murder), he told reporters outside Aluva Police Club. Earlier, the policemen were questioned in the club. HC seeks EC response on plea to de-register Shiromani Akali Dal

The Delhi High Court today sought response of the Election Commission (EC) on a plea for de-registration of Sukhbir Singh Badal-led Shiromani Akali Dal (SAD) by two persons who alleged that the registration was obtained after giving a "false" undertaking that it was a "secular" outfit. A bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar issued notice to the apex poll panel, the SAD, the Shiromani Gurdwara Prabandhak Committee (SGPC) and others on the plea which sought de-registration of the party claiming that it "intentionally withheld" from the EC the real party 'Constitution/Rules and Regulations' of 1974 which limit "membership of the party to adult Singhs and Singhnis". Lawyer counters UIDAI, tells SC can't open account without Aadhaar

A senior lawyer today told the Supreme Court that he was not allowed to open a fixed deposit account without the Aadhaar number, while challenging the UIDAI for maintaining that authentication of the 12 digit unique national identifier was not required for every transaction. Senior advocate Shyam Divan, who represents former HC judge Justice (retd) K.S. Puttaswamy who is opposed to Aadhaar, countered the submission of senior advocate Rakesh Dwivedi, appearing for the Unique Identification Authority of India (UIDAI), that Aadhaar authentication was not required for all transactions. "I do not have Aadhaar. I went to UCO bank branch in the Supreme Court for opening a fixed deposit account. I referred to the Supreme Court order. HC reserves order on BJD MP bail plea

The Orissa High Court today reserved its order on the bail plea of BJD MP Ramachandra Hansda, arrested for his alleged role in a ponzi scam involving cheating and embezzlement of funds. Justice S K Mishra reserved order on Hansda's bail plea after hearing arguments by counsel for both the Mayurbhanj MP and the CBI, which had arrested him in November 2015. Elected on a BJD ticket from the Mayurbhanj (ST) Lok Sabha constituency in 2014, Hansda was arrested on charges of criminal conspiracy, cheating and diversion of funds while he was the director of Nabadiganta Capital Services, a ponzi company. While Hansda has been in CBI custody for more than two years now, his constituency has gone unrepresented in Lok Sabha for last 29 months.

Fodder scam case: 14 years jail to animal husbandry dept's ex-director

A special CBI court, which on April 9 convicted 37 people in a fodder scam case pertaining to illegal withdrawal of money from Dumka treasury, today awarded years of imprisonment to former regional director of the Animal Husbandry Department Omprakash Diwakar. The court also imposed a penalty of Rs 2 on him in connection with illegal withdrawal of Rs 34.92 crore between 1991-92 and 1995 and 96 from the treasury. The court of Shiv Pal Singh sentenced Diwakar to seven years in prison and Rs 1 crore penalty under IPC sections 120B, 420, 409, 467, 468, 471 and 477A and another seven years and Rs 1 crore penalty under sections 13 (2) r/w 13 (1) (c ) &(d) of Prevention of Corruption Act. Both the sentences would run consecutively. The court also sentenced other former treasury officials and fodder suppliers between 3.5 and seven years and slapped up to Rs 1 crore fines on them. Bains demands permanent panel to probe into 'false cases'

Lok Insaaf Party chief and MLA Simrajit Singh Bains today demanded setting up of a permanent panel to probe into "false cases" registered against people, especially "activists of political adversaries" of the ruling Congress. Addressing a dharna by Dalit activists here, he said Chief Minister Amarinder Singh has set up Justice (retd) Mehtab Singh Gill Commission to probe into "false cases" registered during 10 years of SAD-BJP rule. CBI closes Satish Shetty murder case again, cites lack of evidence

The CBI has filed a closure report in the RTI activist Satish Shetty murder case in Pune, who was hacked to death 10 years ago, claiming it could not find enough evidence against the accused, officials said here today. They said the final report in the case was filed before the competent court recently as the probe could not bring out enough evidence to prosecute the accused. It is alleged that Shetty was trying to expose a major land scam involving a high-profile builder which triggered his gruesome murder on January 13, 2010. Two retired police officers were taken into custody in connection with the case for alleged tampering of evidence and were charge sheeted by the agency, they said. It is not the first time the agency has filed a closure report in the case. Minor raped in Odisha's Kalahandi district, 1 held

An eight-year-old girl was allegedly raped by her uncle in Odisha's Kalahandi district, police said today. The incident comes days after three similar cases of minors' rape were reported from three different places - Nilagiri, Soro and Khaira - in the state's Balasore district. The incident in Kalahandi occurred yesterday near Bachaka village under the jurisdiction of Biswanathpur police station, the police said. The accused offered fruits and took the girl to a nearby forest, the Additional Superintendent of Police (ASP) of Kalahandi, Gopinath Mani Patra, said. The accused, who happens to be a cousin of the girl's late father, allegedly raped her inside the forest, the ASP said. After returning home, the girl, a student of class III, narrated everything to her mother and then the girl's mother lodged a complaint with the police, he said. A case was registered against the accused on the basis of the FIR and he was arrested, the ASP, who is in-charge of the investigation .

HC grants stay in another FERA case against Dhinakaran

The Madras High Court today stayed proceedings in a lower court here against AMMK leader T T V Dhinakaran in a 22-year-old FERA case filed by the Enforcement Directorate (ED). Justice R M T Teekaa Raman granted the interim stay on a criminal revision petition by Dhinakaran against an April 11 order of the Additional Chief Metropolitan Magistrate (ACMM) Court, Economic Offence, refusing to halt further proceedings in the case. He had sought the relief in the ACMM court in the case related to alleged illegal routing of USD 36,000 and 0.1 million pounds for starting a star hotel in the UK citing the high court's stay of proceedings in another FERA case against him. The other case related to alleged receipt of USD 10.4 million in foreign exchange without obtaining prior permission from the Reserve Bank of India (RBI) and depositing it in the account of Dipper Investments Limited, a company incorporated in the British Virgin Islands. UP: Three cops booked after assaulting doctor

A government doctor on duty was allegedly assaulted by three policemen at the district hospital here following which an FIR was lodged against them, the police said today. A group of doctors reached the city police station this morning and on the complaint of the doctor, the FIR was lodged against three cops and one unidentified man under different sections of IPC, they said. The cops have been identified as constable Durgesh Pathak, constable Manoj Chowdhary and SI Anjani Kumar, police said. According to the complaint, Dr Rakesh Kumar was on duty at emergency ward of the hospital and at around 1.30 am, Pathak, who was in uniform, came in an inebriated state and had some injuries. Pathak got into an argument with the doctor and misbehaved with him as he, along with a a pharmacist, began attending him, police said, adding that the cop also tore the register of the ward. Kathua rape case: Media houses apologise in HC for revealing identity, asked to pay Rs 10L each

The Delhi High Court today directed 12 media houses to pay a compensation of Rs 10 lakh each for revealing the identity of the eight-year-old Kathua rape victim in Jammu and Kashmir. The court also indicated that it may enhance the amount that has to be deposited by the media houses in the Jammu and Kashmir Victim Compensation Fund, which have apologised for revealing the details of the victim. It asked them to file separate affidavits explaining their conduct in three days and directed that the compensation amount of Rs 10 lakh each should be deposited with the registrar general of the high court within a week. The money would be transferred to the Jammu and Kashmir legal service authority's account to be used for the Jammu and Kashmir's victim compensation fund.
