BJP leader moves SC seeking direction over conviction in corruption cases

Bharatiya Janata Party (BJP) leader Ashwini Upadhyay on Wednesday filed a petition in the Supreme Court seeking direction that conviction under the Prevention of Corruption Act, 1988, Prevention of Money Laundering Act, 2002, Foreign Contribution (Regulation) Act, 2010 and Companies Act, 2013, shall be consecutive only.Under consecutive sentences, a person convicted in multiple offences has to serve sentence for each of the offence separately, one after the other.Upadhyay, in his petition, also sought a direction to the Central Government to constitute a committee chaired by a retired Supreme Court judge to examine anti-corruption law, Benami property law and anti-money laundering law of developed democratic countries and take appropriate steps to implement their best practices.

Judicial Services Asso condemns attack on Judge;seeks security

The Bihar Judicial Services Association today strongly condemned attack on a judge in a running train and demanded adequate security for Judicial Officers of the state. The Association demanded the state government to take preventive measures by providing bodyguards to all male and female judicial officers irrespective of rank. Two persons were arrested yesterday evening in the case and they have been forwarded to jail. It may be noted that a Sub-Judge Prashant Kumar Jha, who was posted as Additional Chief Judicial Magistrate at Pupri sub-divisional court of Sitamarhi district, was attacked and badly injured by some people in a moving train in the evening of Monday last. The attack took place when the Judge was on his way to Patna from Gaya after completing some personal work. SC holds Indian naval officer guilty of making obscene calls to wives of other officer

The Supreme Court today held an Indian naval officer guilty of making sexually explicit calls to wives of fellow officers, but reinstated him in service after forfeiting his two years' seniority and depriving him of five years' salary. The apex court upheld the order of the Armed Force Tribunal (AFT), which had pronounced him guilty on seven charges and had directed that he be reinstated after forfeiture of 24 months' seniority, rejecting the officer's contention that the tribunal's conclusion was "utterly perverse" . A bench of justices A K Sikri and Ashok Bhushan said that the "ends of justice" will be met in the case as the officer has been out of service since January 26 2013, and his seniority has been forfieted by 24 months. "However, no case is made out that the conclusion arrived at by the Tribunal was utterly perverse which no reasonable person could have arrived at. HC stays NCSC's recommendation to lodge FIR against four faculties of IIT Kanpur

The Allahabad High Court today stayed the recommendations of the National Commission for Scheduled Castes (NCSC) asking IIT Kanpur's director to lodge an FIR against four faculty members for committing atrocities against an assistant professor belonging to a scheduled caste. The bench comprising justices Krishna Murari and Ashok Kumar passed the order while hearing a petition filed by Ishan Sharma and three others. The court also stayed its recommendation to stay the appointment of one of the petitioners, Rajiv Shekhar, as director of IIT (ISM), Dhanbad, and direction to remove the faculty members from the membership of the Departmental Faculty Affairs Committee of the Aerospace Department. The court, however, clarified that the administration of IIT Kanpur might proceed to hold disciplinary proceedings against the professors in accordance with law, if they so desired. HC stays restored NOC to explosives unit

The Madras High Court today stayed the restoration of no-objection-certificate to an explosives processing unit in Tiruchirapalli district, where a fire and subsequent blasts had claimed 19 lives on December 1, 2016. A Madurai bench of justices C T Selvam and Basheer Ahamed stayed the NOC to Vetrivel Explosives on a plea by a resident of Murgapatti village, where the unit is located. The village resident, K Periyasamy had challenged the NOC's restoration of the plant, contending that it had been done illegally under an improper exercise of jurisdiction by the district revenue officer (DRO) on March 23, 2018. On Periyasamy's petition, the court also issued notices to the state's chief controller of explosives, the Tiruchirapalli district collector and the DRO, directing them to file their replies to the plea within four weeks In his petition, Periyasamy contended that the DRO, instead of pursuing the criminal case against the factory owner, had chosen to restore the NOC. HC orders radiological examination of Goa priest's body to determine cause of death

The Bombay High Court today ordered the Crime Branch of the Goa Police to conduct a radiological examination of the body of a Christian priest-turned-activist to ascertain the cause of his death, more than two years after he was found dead under mysterious circumstances. Hearing a plea of family members of deceased Fr Bismarque Dias who had challenged the decision of the Crime Branch to close the case, a division bench of justices N M Jamdar and Prithviraj Chavan directed that the radiological examination be conducted on the remains of Dias (51) and a report submitted on April 20. The closure report of the Crime Branch before a lower court had stated that it was an accidental death. Dias' remains are being preserved at the Goa Medical College and Hospital (GMCH) as his kin had refused to bury him on suspicion of a foul play behind his death. History-sheeter killed in Visakhapatnam

A 32-year-old history-sheeter was killed by some persons suspected to be belonging to a rival gang, police said today. The deceased Suvvada Mahesh was allegedly involved in many murder cases in the city, they said. Sources said Mahesh was killed following a dispute between him and his friends after a party last night. A special team has been formed to nab the accused, police said. Over five history-sheeters have been killed in the city during the past few years and in most cases old-rivalry is suspected to be the prime reason, they added.

Four arrested for betting on IPL matches

Four persons have been arrested here for alleged involvement in betting on IPL matches, police said today. Vig unearths property documents worth Rs 2.15 cr from

Special Vigilance Unit (SVU) sleuths have recovered huge cash, jewellery and property documents worth Rs 2.15 crore during raid at suspended SSP Vivek Kumar's in-laws' residence in Uttar Pradesh. Man jailed for ten years for raping a minor

A sessions court here today sentenced a man to 10 years in jail for raping a minor three years ago. Additional District and Sessions Judge Om Prakash Srivastava sentenced Roshan Kumar after convicting him of various offences under Protection of Children from Sexual Offences (POCSO) Act, 2012. The court also imposed a fine of Rs 50,000 on him. Additional Public Prosecutor Rajesh Kumar Sinha said Roshan Kumar had on July 28, 2015 allured an eight-year-old girl to a desolate place and raped her. The convict and the victim were the residents of Bauri village under Kashichak police station of Nawada district, the APP said, adding that an FIR was lodged the same day on the complaint of victim's mother.

In talks with UK for extradition of Khaleda Zia's 'convicted fugitive' son Tarique Rehman: Hasina

Bangladesh Prime Minister Sheikh Hasina has said her government was in talks with the UK authorities for the extradition of former premier Khalida Zia's "convicted fugitive" son, Tarique Rahman. Rahman, who is living in London since 2007, has been convicted and sentenced to seven years in jail in 2016 by a high court in a money laundering case and was also slapped a fine of Taka 200 million. He has also been declared absconder by a trial court in a case related to deadly grenade attack on a rally by the then opposition and now ruling Awami League at Bangabandhu Avenue on August 21, 2004, which left 24 people dead and more than 300 others injured. 210 kg cannabis seized in Thane district; four held

Four persons from Badlapur in Maharashtra's Thane district were arrested today for illegal possession of over 200 kg cannabis worth Rs 31.44 lakh, police said. While one of the accused, identified as Naresh Ahire (19), was arrested near the Badlapur state transport bus stand yesterday, three others from a farm house in Dokhe Dapivali village, a senior police officer said. The collective quantity of the contraband is around 210 kgs, he said. Police also seized two four-wheelers worth Rs 37 lakh from the premises of the farm house. The other accused are identified as Kunal Kadu (25), Sunny Pardeshi (20), and Amol Dhangaon (19). They are booked under appropriate sections of the Narcotic Drug and Psychotropic Substances (NDPS) Act.

Sealing: Task force to examine safety of buildings, Centre tells SC

The Centre today told the Supreme Court that the special task force (STF), which would be set up to oversee the enforcement of laws to deal with unauthorised constructions and encroachments in Delhi, would also look into the safety aspects of buildings which have been built legally. The government told a bench of Justices Madan B Lokur and Deepak Gupta that the STF would examine the safety aspects, like fire fighting, in buildings like schools, hospitals, theatres and restaurants to see whether they complied with the norms. Additional Solicitor General A N S Nadkarni (ASG), appearing for the Centre, told the bench that they have added one representative from the office of Delhi's Lieutenant Governor in the task force, which would be chaired by the vice-chairman of the Delhi Development Authority (DDA). 4 arrested for killing two sisters

Four persons were arrested for allegedly murdering two sisters in the Basrehar area here, the police said today. Vinit alias Jitu and his friends Ativeer, Anand and Ranjeet were arrested yesterday, Senior Superintendent of Police Ashok Kumar said. During interrogation Vinit told the police that he shot dead the sisters when the elder sister (19) declined to meet him when he asked her to do so on April 16. Both the sisters -- the younger aged 14 -- were missing since the night of April 16 when they had gone to relieve themselves in a field. Their dead bodies were recovered yesterday. The incident was a fall out of a one-sided love affair, Kumar said.

1988 Road rage case: SC reserves verdict on Navjot Singh Sidhu's appeal

Cricketer-turned-politician Navjot Singh Sidhu, who was awarded three-year jail term by the Punjab and Haryana High Court in a 1988 road rage case, today told the Supreme Court that the evidence about the cause of death of the victim was "contradictory" and the medical opinion "vague". Sidhu, who had quit the BJP and joined the Congress days before the Punjab assembly election last year, told a bench of Justices J Chelameswar and Sanjay Kishan Kaul that the "most baffling issue" in the case was with regard to the cause of death of the victim, Gurnam Singh. SC asks Jay Shah, web portal to try to settle defamation case

The Supreme Court today asked Jay Shah, son of BJP president Amit Shah and 'The Wire' and its scribes, to try to amicably settle the criminal defamation case lodged by the former against the news portal and others.
