No need of NIA probe into Kasganj incident: High court

The Allahabad High Court today declined to order an NIA probe into the Kasganj communal clashes. A Lucknow bench also refused to issue any direction to the state government to award Rs 50 lakh compensation to the family of the deceased and grant status of martyr to him. The bench of justices Vikram Nath and Abdul Moin was disposing of a PIL filed by Dileep Kumar Srivastava and others in the matter. Appearing for the petitioners, advocate Hari Shanker Jain questioned the alleged double standards in granting compensation to riot victims of different communities. Opposing the PIL, state lawyer said that the Uttar Pradesh government had already granted compensation to the deceased and that the state police was conducting investigation into the incidents and as such there was no need of probe by the NIA. The Congress on Wednesday demanded a Supreme Court-monitored Special Investigation Team probe into the "suspicious" death of judge B.H. Loya in December 2014, saying there seemed to be a "cover-up" and "some serious questions were unanswered".

IAF officer taken into custody on charges of espionage

A Group Captain, posted at the IAF's headquarters here, has been taken into custody by the force for alleged involvement in espionage and possible attempt to access sensitive documents, official sources said today. The investigators are also probing whether the officer was a victim of honey trap. The officer was indulging in certain "unwanted activities" through unauthorised electronic devices which is against existing orders, the sources said. Apparently, he was in touch with a woman through social media whose identity has not yet been established. A team of the IAF's central security and investigation took the officer into custody, and currently he is being interrogated, said the sources. The "unwanted" activities by the officer were discovered during routine counter intelligence surveillance, the sources said, adding he attempted to posses sensitive documents. Income Tax dept slaps Rs 436.80 cr penalty on NDTV

New Delhi Television Ltd (NDTV) today said income tax department has levied a penalty of Rs 436.80 crore on the company for assessment year 2009-10. The company today received an order under section 271 (1) (C) of Income Tax Act from the Income Tax Department levying penalty of Rs 436.80 crore for the assessment year 2009-10, NDTV said in BSE filing. The company said it is currently examining the order and legal option available to it. It will take necessary action accordingly. Section 271(1)(c) provides for levying penalty in case an assessee has concealed income particulars or furnished inaccurate details.

Mathur Commission: Rajasthan Lokayukta submits report to Guv

Rajasthan Lokayukta Justice S S Kothari today submitted its 757-page probe report to Governor Kalyan Singh on 1,828 cases that were pending with the Mathur Commission. The Justice N N Mathur Commission was constituted in 2009 to probe cases pertaining to land use conversion, land allotment, corruption and irregularities by public servants during 2004-2008, the lokayukta said in a release. The constitution of the commission was challenged through a PIL in the Rajasthan High Court, it said. The high court had then directed the lokayukta to conduct a fresh probe into the cases pending with the Mathur Commission, the release said. Twenty-eight of the 199 land conversion cases were cancelled, and rules and regulations were not followed in 38 cases, in which action was taken, it said. SC upholds HC order denying bail to ex-MLA in MCOCA case

The Supreme Court today upheld the decision of the Delhi High Court denying statutory bail to a former MLA who was arrested in December 2016 for offences under the stringent MCOCA. A bench headed by Chief Justice Dipak Misra said that there was "no infirmity" in the high court order as the Delhi Police had already filed a plea before the trial court seeking extension of time beyond the statutory period of 90 days for filing the charge sheet against former city MLA Rambeer Shokeen. Shokeen, who was booked under the Maharashtra Control of Organised Crime Act (MCOCA) for allegedly running a crime syndicate in Delhi and adjoining states along with others, had alleged that he was entitled for grant of statutory bail as the police had sought extension of time for filing the charge sheet after the expiry of 90-day period. Haripur molestation: 2-day remand for suspects

Sri Lanka sets up special courts for Rajapaksa-era graft

Sri Lanka is to set up special courts to investigate charges of corruption amounting to billions of dollars under former president Mahinda Rajapaksa, the government said today. The move, designed to accelerate the process of trying such cases, follows criticism over the slow pace of justice under the government elected three years ago. President Maithripala Sirisena came to power in 2015 promising to stamp out corruption and punish members of the former administration accused of stealing vast sums from Sri Lanka's coffers during Rajapaksa's decade in power. "There will be special three-judge high courts set up exclusively to hear bribery and corruption cases which are currently clogging the lower courts," the government said in a statement. JJB extends interim bail of girl accused of attacking junior

The Juvenile Justice Board (JJB) today extended till February 7 the interim bail of a class 8 girl accused of attacking a class 1 boy of her school with a sharp weapon. The six-year-old was allegedly attacked in the toilet of the Brightland School in Triveni Nagar here by the girl on January 17. She was granted interim bail earlier and the regular bail plea was to be heard yesterday, but the matter was deferred for today. The counsel for the boy today pleaded that the age of the girl should be determined on the basis of medical examination. However, the girl's counsel argued that it should be determined on the basis of school certificates. The JJB directed both the counsels to bring their pleas on record by way of the affidavit and fixed February 7 as the next date for hearing. Undertrials in jails: Delhi HC unhappy with district judges

The Delhi High Court today termed as "pathetic" the exercise of providing information to it by district judges on undertrials who have been unable to secure release from jail despite grant of bail. A bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar said the district judges were directed to collect the data of those entitled to be released from jail and carry out an assessment as to whether their release would pose a risk to society. "This is unfortunate and pathetic. This is how our senior judicial officers work. They were asked to give their report, instead they collected letters and documents from all trial court judges on the issue and sent the same to us as it was," it observed. "Now we will do this exercise. We will go through this letters of all trial court judges," it said. Deliberations to resolve the issues that were raised at the January 12 presser by four seniormost Supreme Court judges continued today with Chief Justice of India Dipak Misra meeting other judges over lunch. However, Justice J Chelameswar, who had led the four judges in the unprecedented press conference, was not present during the discussions as he was on leave today. Sources said that the apex court judges met over lunch hosted by Justice A K Goel and some discussions took place among them. The outcome of the deliberations was not known. Cong raise more questions in judge Loya's death case

The Congress today raised more questions over the death of judge B H Loya and demanded a Supreme Court-monitored probe by a special investigation team (SIT) into the case. The Congress said the SIT should not have officers from the CBI and the NIA and added that if there is no proper probe into the matter, the party will go to "each village of the country". Speaking to reporters here, senior Congress leader Kapil Sibal alleged that "democracy is in danger" and judges, lawyers and even media personnel were not safe these days. He also questioned why the Bombay High Court did not lodge an FIR following Loya's death. Odisha Chief Minister Naveen Patnaik today issued a direction to include the "suicide" of the minor girl from Koraput district in the term and reference of the judicial commission already probing into alleged gang rape of the victim. While asking the Home department to expand the term of reference of the judicial panel, Patnaik said: "The circumstances leading to alleged suicide by the minor girl be added to the existing term of reference for the judicial probe." Earlier, the Home department on December 26, 2017, had issued a notice on the formation of a judicial panel headed by the district judge of Koraput district. 2 killed in firing in Lahore's sessions court

At least two persons - a police official and an under-trial murder suspect - were killed today when an armed man opened fire on them on the premises of the sessions court in Lahore, the capital of Pakistan's Punjab. Superintendent of Police (city) Ali Raza told PTI that murder suspect Amjad was brought hand-cuffed to the sessions court from the camp jail for hearing when an armed man (later identified as Tauqeer) posing as lawyer (to skip security check) entered the court premises and opened fire on Amjad. "Amjad died on the spot. When the policemen present there rushed to catch him he opened fire on them leaving two of them injured," Raza said. Gold worth Rs 39 lakh seized at airport

A passenger has been arrested at Mangaluru International Airport here for trying to smuggle gold worth Rs 39 lakh from Dubai, Revenue intelligence officials said today. The passenger, who has been identified as Ahamed Nabeel Gaffoor (21), a resident of Kasaragod in Kerala, was arrested on arrival from Dubai by SpiceJet flight SG-60 atsix pmyesterday, a DRI release here said. Acting on credible intelligence, he was intercepted right at the aircraft door and was escorted to customs arrival area and subjected to thorough checking, it said. It was revealed that he was carrying a mobile-like item in his front trouser pocket. The mobile pouch was found to be heavier than usual and it was sealed from all sides. Two held after volunteers clash during 'Tiranga' yatra

Three persons were injured after volunteers clashed among themselves during a 'Tiranga' rally being taken out by some Hindu organisations here today, police said. Two persons were arrested following the incident, they added. The rally was taken out by activists of the Hindu Yuva Vahini and Bajrang Dal in the wake of the killing of a youth, Chandan Gupta, in Kasganj last week. Tilhar police station incharge Razi Ahmed said, "Workers of Hindu Yuva Vahini and Bajrang Dal were today taking out a motorcycle rally, when there was a dispute between two of them over money." One of the workers hurled a stone creating commotion while another was beaten up allegedly by fellow volunteers, he said. "In the stone pelting, Brijesh Kumar, Pradyuman and Govind were injured," Ahmed said. Police arrests two persons in connection with rape of girl

Police today arrested two persons in connection with rape of a minor girl in Khurda district, who had allegedly committed suicide over alleged police inaction. The rape victim, a Class 10 student from Suanpadia village, had committed suicide on January 24 over alleged police inaction and not getting justice. Two persons were arrested from near Kunjuri, police said adding that the arrested persons have been identified as Nimai Palei (22), the prime accused in the case, and his brother Kedar Palei. The villagers had staged road blockade by placing the girls body in front of Banapur Police Station on January 25. According to the FIR lodged by the victim's family on January 2, the minor girl was allegedly raped by Nimai Palei of the same village, while she was on her way to attend natures call on December 31 last year.
