The Supreme Court Tuesday refused to entertain a PIL seeking establishment of a separate bench of the Allahabad High Court in western Uttar Pradesh, saying this was not the right forum. A bench comprising Chief Justice Ranjan Gogoi and justices S K Kaul and K M Joseph said though a good issue has been raised in the petition, but the apex court cannot deal with it "on judicial side". When lawyer K R Chitra, appearing for NGO 'Fight For Human Rights, said the litigants of western Uttar Pradesh also need smooth access to the high court, the bench said, "you are absolutely right, but the choice of the forum is wrong". "The prayer made in the writ petition i.e. establishment of a permanent Bench of the High Court of Allahabad for western Uttar Pradesh cannot be the subject matter of judicial determination and directions. A 10-year old girl was seriously injured on Tuesday when a toy car found on the road near her house at the Manipuri Basti here exploded when she played with it, the police said. Her mother of the class three girl was also injured in the explosion, the police said. Her neighbours said that a packet containing the toy car was found by a person on the road and the girl took it inside her home to play with it. As she was pushing it around an explosion occured grievously injuring the girl and her mother, who was nearby, they said. The girl was immediately rushed to hospital where doctors said one of her eyes was damaged due to explosive particles entering it. Her face suffered multiple injuries as did her body and two of her fingers were severed. The mother was injured on her legs, the doctors said. Police said its teams with forensic experts have rushed to the spot and have begun investigations to find out the nature of the explosive and who may have kept it at the spot.
Expressing concern over extraction of groundwater, the National Green Tribunal has suggested use of treated sewage water by farmers for agricultural purposes instead of potable water. A bench headed by NGT Chairperson Justice Adarsh Kumar Goel said at a time when there is serious depletion of the water table there was a need to switch over to less water consuming crops. "We do appreciate the difficulties of the agriculturists but the option of providing alternative of use of treated sewage water etc or switching over to less water consuming crops needs to be considered," the bench, also comprising Justice S P Wangdi, said. The Supreme Court Tuesday agreed to hear on January 22 in open court the pleas seeking review of its verdict which allowed entry of women of all age groups into Kerala's Sabarimala temple, but refused to stay the judgement. Five poachers in Delhi and Kerala were sentenced to rigorous imprisonment by local courts in two separate cases for killing tigers, according to a CBI statement. In the first case, Ernakulam Chief Judicial Magistrate sentenced Gireesh and Siby Jose, both resident of Idukki, to three years of rigorous imprisonment and imposed a fine of Rs 10,000 each, it said. The CBI had registered a case after allegations were levelled that the accused had entered into a criminal conspiracy at Nedumkandam, Adimali and other places in 2005. They had encroached the reserve forest of Munnar forest division in Idukki, killed a tiger and took away its skin for sale, the statement said. The tiger skin was seized by forest officials on July 22, 2015 from the accused's residence, it said, adding the trial court convicted two accused and acquitted four others. An assistant sub-inspector (ASI) of police has been suspended after he allegedly, in an inebriated condition, misbehaved and fought with a youth in Kaimur district in dry Bihar, police said on Tuesday. The incident happened on Monday night under the jurisdiction of Ramgarh police station when the youth was returning home in Ramgarh town, the police said. The youth, Abhimanyu Gupta, lodged an FIR on Monday and in his complaint he mentioned that ASI Mantun Kumar, under the influence of alcohol, misbehaved with him and also indulged in a fight with with him, the Deputy Superintendent of Police (DSP) of Kaimur district, Raghunath Singh, said. The ASI was sent to a Bhabua Sadar Hospital for medical examination on Monday night and the doctors confirmed that the ASI had consumed liquor, the DSP said. The AAP government on Tuesday told the Delhi High Court that CCTV cameras are likely to be installed in all DTC buses in the national capital by May next year. The submission was made before a bench of Chief Justice Rajendra Menon and Justice V K Rao during the hearing of a PIL by a lawyer. The petitioner has sought installation of CCTV cameras, and other safety and security features in all buses of the Delhi Transport Corporation (DTC). The court listed the matter for hearing in January after the advocate appearing for petitioner Manish Kumar opposed the Delhi government's submission and said earlier the DTC had claimed there were marshals present in some of its buses, but this was not correct. The counsel sought time to file a response to the status report filed by the Delhi government, following which the court listed the matter for hearing in January. Justice S K Seth will take oath as Chief Justice of the Madhya Pradesh High Court Wednesday. High Court Registrar (Administration) Satish Chandra Rai said that Governor Anandiben Patel will administer the oath of office to Justice Seth in Bhopal. Seth, the senior-most judge of the MP High Court at present, was made acting Chief Justice after Chief Justice Hemant Gupta was elevated to the Supreme Court . Seth will be the 24th Chief Justice of the MP High Court. Before becoming a high court judge, Seth had served as an additional advocate general. He was enrolled as an advocate on July 24, 1981 and practised in Jabalpur. He was appointed a high court judge on March 21, 2003 and was made a permanent judge on January 19, 2004, as per the high court website. He is due to retire in June 2019.
The Delhi High Court Tuesday sought responses from the AAP government and Tihar prison authorities on allegations by some inmates that the Tamil Nadu Special Police, which takes care of the jail's security, was violating human rights. The inmates of a high-risk ward of the jail levelled the allegations in a letter to the court, which was converted into a PIL by a bench of Chief Justice Rajendra Menon and Justice V K Rao. The bench issued notices to the Delhi government, director general of prisons, the Tamil Nadu Special Police (TSP) and some of its officers, who have been named in the communication, seeking their stand on the issue. The Madras High Court Tuesday stayed the Rs 2 crore penalty imposed by the National Green Tribunal on Tamil Nadu Public Works Department for failing to initiate appropriate pre-monsoon preparedness work here, particularly for the Buckingham Canal. A division bench comprising justices MM Sundresh and Krishan Ramaswamy passed the interim order on an appeal moved by the public works department (PWD) challenging the order. On October 31, the NGT imposed the fine, noting that the pace of work undertaken by the PWD to resolve these issues was disappointing. The order was passed on a plea by activist Jawaharlal Shanmugam seeking restoration of rivers and canals in the city. Justice R K Gauba reserved the verdicts on the two petitions after hearing the arguments of the lawyers of the two leaders. In her plea, Irani has sought quashing of the summons issued to her by a trial court on June 6, 2014. She has also sought quashing of the complaint filed by Nirupam.
