SC/ST, OBC quota would not apply to minority institutions: Madras HC

The Madras High Court has held that the concept of communal reservation or reservation for Scheduled Castes, Scheduled Tribes and other Backward Classes of citizens would not apply to minority institutions. The first bench comprising Chief Justice S V Gangapurwala and Justice P D Audikesavalu gave the ruling while partly allowing an appeal and a petition from Justice Basheer Ahmed Syed College for Women (Autonomous) in the city, assailing a November 2021 order, rejecting the extension of religious minority status to the college. The college also sought a direction to issue the Permanent Religious Minority status certificate. Though reservation was made applicable to the socially and educationally Backward Classes of citizens, the SCs and the STs for admission, from the educational institutions, the minority educational institutions were consciously excluded from the operation of Article 15(5) of the Constitution of India, the bench said. It noted that Article 15(5) of the Constitut

Caste survey a brave step forward, other states should follow: NCP MLA

The Sharad Pawar-led Nationalist Congress Party (NCP) MLA Jitendra Awhad has hailed the Bihar government's caste survey and demanded that a similar exercise be carried out in all states of the country, including Maharashtra, alleging that the rights of the OBCs were being snatched away. The member of the Maharashtra legislative assembly representing the Mumbra-Kalwa constituency in Thane district made this demand in a video message posted on social media platform X on Monday night. "Bihar has taken a brave step forward. It took a decision to conduct a caste-based census. And what truth came out of it (caste-based census)? It revealed that the Other Backward Classes (OBCs) comprise 61 per cent of the population. The Scheduled Castes, Scheduled Tribes and OBCs together form 85 per cent of its population," he said. "And the truth that came out in Bihar is the truth of the entire India. And therefore we demand...we have always demanded that at least bring out the exact caste-wise ...

OBCs, EBCs comprise more than 63% of Bihar's population: Caste survey

The Nitish Kumar government in Bihar on Monday released findings of its much-awaited caste survey, which revealed that OBCs and EBCs constitute a whopping 63 per cent of the state's total population. According to the data released here by Development Commissioner Vivek Singh, the state's total population stood at a little over 13.07 crore, out of which, the Extremely Backward Classes (36 per cent) were the largest social segment followed by the Other Backward Classes at 27.13 per cent. The survey also stated that Yadavs, the OBC group to which Deputy Chief Minister Tejashwi Yadav belongs, were the largest in terms of population, accounting for 14.27 per cent of the total. Notably, the survey was ordered last year after the Narendra Modi government at the Centre made it clear that it would not be able to undertake a headcount of castes other than SCs and STs as part of the census.

Will conduct caste-based census for OBCs if voted to power: Rahul

Congress leader Rahul Gandhi on Saturday said if his party comes to power at the Centre, it would conduct a caste-based census to know the exact number of Other Backward Classes (OBCs) people in the country. He was addressing a public meeting in Kalapipal assembly constituency in Shajapur district of Madhya Pradesh. "Soon after coming to power, the first thing we will do is to go for a caste-based census to know the exact number of OBCs in the country as no one knows their exact number," Gandhi said. He claimed that the country was being run by only 90 officers, including the cabinet secretary and secretaries, while the BJP MPs and MLAs had no role in framing policies and laws in the country. The Rashtriya Swayamsevak Sangh (RSS) and bureaucrats are framing laws instead of elected BJP members, Gandhi alleged. Terming Madhya Pradesh as the "epicentre" of corruption in the country, Gandhi said, "Scams like Vyapam have rocked the state. MBBS degrees are being sold, exam papers are be

OBC leaders to look for ways to seek reservation in women's quota Bill: Uma

Leaders from Other Backward Classes have agreed to a big meeting on Saturday to find ways to seek quota for OBCs in the just-cleared women's reservation bill, senior BJP leader Uma Bharti has said on X. The former Madhya Pradesh CM, however, has not shared details about the time and venue of the meeting of the OBC leaders on September 23. The bill to reserve one-third of the seats in the Lok Sabha and state assemblies for women received the parliamentary nod on Thursday as the Rajya Sabha unanimously voted in its favour. Now, if a path is to be chalked out to raise the demand for another amendment for reservation for OBCs, a discussion (in that regard) was held with backward class leaders from in and around Bhopal. It was decided to call another big meeting on September 23, she wrote on X, sharing pictures of those who were part of the meeting at her Bhopal residence. Women's Reservation Bill incomplete without OBC quota, caste census: Gehlot

Rajasthan Chief Minister Ashok Gehlot on Thursday said the women's reservation bill has been welcomed by everyone but is incomplete without OBC reservation and the caste census. Speaking to reporters after a programme here, Gehlot said the bill has been brought for political gain with an eye on upcoming elections under the pressure of the opposition. "If they (Centre) wanted, they could have done it nine years ago because they had full majority. If you have majority then the work becomes easy. Even then they did not do it. Now elections are also coming. It is understood that if the opposition (India alliance) is raising the issue of caste census, then caste census is also important," Gehlot said. The Government of India itself should come forward and do what Sonia Gandhi and many opposition parties felt that you should give reservation to SC/ST/OBC. Make reservation for them also in the 33 percent reservation for women. Then only, all castes, all classes will get a chance to come .

Maharashtra Chief Minister Eknath Shinde on Monday announced the withdrawal of police cases filed against pro-Maratha reservation protesters in Jalna district, the epicentre of the latest round of stir on the issue, and urged quota activist Manoj Jarange to end his indefinite fast. He also announced the suspension of three police officials involved in lathi-charge on quota agitators in central Maharashtra's Jalna district in the first week of September. The CM made the announcements after presiding over an all-party meeting in Mumbai held in the backdrop of the ongoing Maratha quota agitation led by Jarange. Uddhav demands reservation for Marathas, OBCs during Parl special session

Shiv Sena (UBT) chief Uddhav Thackeray on Saturday demanded the Centre provide reservations to Marathas and OBCs in the special session of Parliament convened later this month, a day after violence erupted in Maharashtra's Jalna over the Maratha quota demand. Addressing Shiv Sena (UBT) workers here, Thackeray slammed the "government brutality" of police baton charging the protestors seeking reservation for Marathas in Jalna on Friday evening. "How can police behave in a way without the directions from someone,"? he asked. Thackeray said he would visit Jalna later in the evening to meet the protestors. On Friday, police baton charged and lobbed tear gas shells to disperse protesters in Antarwali Sarathi on Dhule-Solapur road in Jalna's Ambad tehsil after they allegedly refused to let authorities shift a man on hunger strike for Maratha quota to hospital. Referring to the National Capital Territory of Delhi (Amendment) Act 2023, Thackeray said when the Supreme Court gave a ruling ..

Gujarat govt announces 27% quota for OBCs in local self-governing bodies

The BJP government in Gujarat on Tuesday announced a 27 per cent reservation for Other Backward Classes (OBCs) in local bodies like panchayats, municipalities and civic corporations on the basis of a commission's report, paving the way for polls in these self-governing institutes. However, in areas notified under the Panchayats (Extension to Scheduled Areas) (PESA) Act -- most of them with substantial tribal population -- the reservation for OBCs in local bodies will continue to be 10 per cent. Also, the existing quota for Scheduled Castes/Scheduled Tribes remain unchanged and there has been no breach of the 50 per cent reservation ceiling, the Gujarat government said. Earlier, OBC reservation in local bodies was 10 per cent in Gujarat. The announcement, based on the Justice Jhaveri Commission report, comes before the Lok Sabha elections and will pave the way of holding of local body polls which were postponed due to the pending quota issue after the Supreme Court mandated that ...
