Hate Speech: 28 States, UT appointed nodal officers, Centre to SC

The central government has informed the Supreme Court that 28 States and Union Territories have appointed nodal officers in compliance with its guidelines to prevent mob violence and lynching following hate speech incidents.The Ministry of Home Affairs has filed a status report on a batch of petitions seeking directions to prevent/curb hate speech.Centre in its status report told the apex court that the States which informed that they have appointed nodal officers are -- Andhra Pradesh, Andaman and Nicobar Islands, Arunachal Pradesh, Assam, Chhattisgarh, Delhi, Goa, Haryana, Himachal Pradesh, Jammu & Kashmir, Jharkhand, Karnataka, UT of Ladakh, Lakshadweep, Madhya Pradesh, Maharashtra, Manipur, Meghalaya, Mizoram, Odisha, Puducherry, Punjab, Rajasthan, Sikkim, Telangana, Tripura, Uttarakhand and Uttar Pradesh.The top court has been hearing a batch of pleas seeking steps to be taken against hate speech incidents.By it's August 25, 2023 order the top court while hearing petitions .

'Pressure' from parents behind suicides, can't regulate coachings: SC

"Intense competition" and "pressure" of parents on their wards preparing for competitive exams are the main reasons for the rising number of suicides across the country, the Supreme Court said on Monday. Hearing a plea that sought regulation of the mushrooming coaching institutes and cited the data on student suicides, a bench of justices Sanjiv Khanna and SVN Bhatti, however, expressed helplessness and said the judiciary cannot pass directions in such a scenario. "These are not easy things. Pressure from parents is behind all these incidents. More than the children, it is the parents who are putting pressure on them. How can the court pass directions in such a scenario," the bench told advocate Mohini Priya, appearing for the petitioner - Mumbai-based doctor Aniruddha Narayan Malpani. SC flags Centre's selective clearing of collegium recommendations

The Supreme Court on Monday flagged the issue of "pick and choose" by the Centre in clearing the collegium's recommendations for transferring high court judges and said this does not send a good signal. The court observed that of the 11 names of judges recommended by the collegium for transfer, five have been transferred but six are still pending -- four from the Gujarat High Court and one each from the high courts of Allahabad and Delhi. A bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia said of the recently-recommended names for judgeship in high courts, eight have not been cleared and some of these judges are senior to those who have been appointed. "As per my information, you have issued transfer orders for five judges. For six judges, you have not issued. Four of them are from Gujarat. SC seeks responses from Centre, ED on Sanjay Singh's plea against arrest

The Supreme Court on Monday sought responses from the Centre and the Enforcement Directorate on AAP leader Sanjay Singh's plea challenging his arrest and remand in a money laundering case related to alleged Delhi excise policy scam. A bench of Justices Sanjiv Khanna and SVN Bhatti issued notice to the Centre and the ED, and asked them to submit their responses before December 11. The bench ordered that if Singh files a petition for regular bail in the interregnum, then it should be considered independent of the observation made in the Delhi High Court's judgement dated October 20. Singh, who was arrested on October 4 in the case, had moved the top court challenging the High Court verdict. SC seeks reply of Centre on Kerala's plea alleging delay in clearing bills

The Supreme Court on Monday sought responses from the Centre and the office of Kerala Governor Arif Mohammed Khan on a plea of the state government accusing him of not granting assent to several bills cleared by the legislative assembly. A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra took note of the submissions of senior advocate K K Venugopal, alleging delay on the part of the governor in granting assent to eight bills. The top court also issued a notice to Attorney General R Venkataramani asking that either he or Solicitor General Tushar Mehta assist it in the hearing. Tamil Nadu, Kerala pleas on 'delay' by governor in Supreme Court on Monday

The Supreme Court is scheduled to hear on Monday two separate pleas of the Tamil Nadu and Kerala governments, alleging a delay by the respective state governors in giving assent to bills passed by the assemblies. A bench of Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra is scheduled to hear the pleas. The Tamil Nadu Assembly re-adopted 10 bills in a special sitting on Saturday, days after those were returned by Governor R N Ravi. A plea has been filed in the Supreme Court for initiation of contempt proceedings against the Securities and Exchange Board of India (SEBI), alleging it has violated the timeline for completing the investigation and submitting its report on the allegations of stock price manipulation by the Adani group. An application has been filed by PIL petitioner Vishal Tiwari saying that despite the deadline given to the SEBI it has failed to comply with the direction of the court and has not submitted the final conclusion/report as was directed by the court. It said by the order dated May 17, 2023, the apex court directed SEBI to submit its report till August 14, 2023. The Haryana government will move the Supreme Court against the Punjab and Haryana High Court order quashing a law that provided 75 per cent reservation in private sector jobs to residents of the state, Deputy Chief Minister Dushyant Chautala said on Saturday. The Supreme Court is scheduled to hear on Monday two petitions, including one alleging a delay on the Centre's part in clearing the names recommended by the collegium for appointment and transfer of judges. EC compiling details of electoral bonds shared by parties, to submit to SC

The Election Commission is in the process of compiling details of electoral bonds shared by various political parties, including the BJP and the Congress, before submitting them to the Supreme Court in a sealed cover, a poll panel functionary said on Thursday. On November 3, the EC had asked "all such parties" that have ever got any donation through electoral bonds to furnish by November 15 the details of such contributions received by them since the inception of the scheme. It had also sent a reminder to the parties on the issue. The EC's move came after the Supreme Court directed the poll panel on November 2 to produce before it in a sealed cover the "up to date" data of funds received by political parties through electoral bonds till September 30, 2023.
