SC judge recuses himself from Umar Khalid's plea on bail in UAPA case

Supreme Court judge Justice Prashant Kumar Mishra on Wednesday recused himself from hearing a plea filed by former JNU student Umar Khalid seeking bail in a UAPA case related to alleged conspiracy behind the riots here in February 2020. Khalid's petition challenging the October 18 last year order of the Delhi High Court, which had rejected his bail plea in the matter, came up for hearing before a bench of Justices A S Bopanna and Prashant Kumar Mishra. "This will come before some other bench. There is some difficulty for my brother (Justice Mishra) to take up this matter," Justice Bopanna said at the outset, without assigning any reason for Justice Mishra's recusal. Advocate Rajat Nair, appearing for the Delhi Police, told the bench that they have filed a counter affidavit but there is an objection shown by the apex court registry on it. Parliamentary panel supports increasing retirement age of SC, HC judges

A parliamentary committee on Monday recommended a performance appraisal system for extending the tenure of judges of the Supreme Court and high courts beyond the existing retirement age. At present, while Supreme Court judges retire at the age of 65 years, judges of the 25 high courts demit office at 62. The Standing Committee on Law and Personnel, in its report on 'Judicial Processes and their Reforms', also said that the practice of post-retirement assignments to SC and HC judges in bodies or institutions financed by public exchequer may be reassessed to ensure their impartiality. It noted that many stakeholders had raised objections to the post-retirement assignments given to judges. During the UPA-II, a bill was introduced in Lok Sabha to bring the retirement age of HC judges on par with SC judges. But the bill never came up for consideration and lapsed. The Supreme Court on Monday commenced hearing on a batch of petitions pertaining to ethnic violence in Manipur, with the state government proposing to set up SITs headed by district SPs to probe cases. Manipur DGP Rajiv Singh also appeared before a bench headed by Chief justice D Y Chandrachud to answer queries on the ethnic violence and steps taken by the administration so far, besides the segregation of cases for the purposes of effective investigation. Attorney General R Venkataramani and Solicitor General Tushar Mehta, appearing for the Centre and the state government, submitted the report, sought by the apex court on August 1, on issues including the segregation of cases. SC to hear pleas against order on removal of Haldwani encroachment tomorrow

The Supreme Court is scheduled to hear on Monday a matter in which it had stayed the Uttarakhand High Court directions for the removal of encroachments from 29 acres of land that has been claimed by the railways in Haldwani. The Supreme Court has stayed a Madras High Court order that declared as "null and void" the 2019 election of expelled AIADMK member P Ravindhranath from Tamil Nadu's Theni parliamentary constituency. A bench of justices Surya Kant and Dipankar Datta admitted the appeal filed by Ravindhranath against the high court order for hearing and issued notice to P Milany, who filed the petition challenging his election from the Theni constituency.
