Delhi govt's challenge to Centre's ordinance referred to constitution bench

The Supreme Court Thursday referred to a constitution bench for adjudication the Delhi government's petition against the Centre's recent ordinance taking away the control of services from the city dispensation. A bench comprising Chief Justice D Y Chandrachud and justices P S Narasimha and Manoj Misra said the detailed order referring the case to a larger bench will be uploaded on the apex court website later in the day. We will refer it to the constitution bench, the bench said after hearing brief submissions advanced by senior advocates Harish Salve, Abhishek Singhvi, appearing for Lieutenant Governor V K Saxena and the Delhi government respectively. Solicitor General Tushar Mehta appeared on behalf of the Centre. The top court had recently issued notices to the Centre and the lieutenant governor on the plea while refusing to grant an interim stay on the ordinance on control over services in Delhi. No consensus between Delhi CM, LG on DERC chairperson appointment: SC told

The Delhi Government and the Lieutenant Governor (LG) on Thursday told the Supreme Court that they have failed to arrive at a consensus on the issue of appointment of DERC chairperson. The top court suggested that it may consider appointing a former judge for some time on an ad-hoc basis and for that, it will have to consult few judges. After a bench headed by Chief Justice D Y Chandrachud was apprised that there was no consensus on the issue, the CJI asked, "Can you both not pick up one judge for appointment as DERC chairperson." Senior advocate Harish Salve, appearing for the Delhi LG, said the top court can suggest names for appointment of Delhi Electricity Regulatory Commission(DERC) chaiperson and he or she will be appointed. 3-judge Bench to hear pleas relating to criminalisation of marital rape: SC

The Supreme Court on Wednesday said that a three-judge bench will hear a batch of petitions pertaining to criminalisation of marital rape after constitution benches conclude hearing some listed pleas. We have to resolve the matters concerning marital rape, a bench comprising Chief Justice D Y Chandrachud and justices P S Narasimha and Manoj Misra said when senior advocate Indira Jaising mentioned the matter for hearing. The Supreme Court on Tuesday reserved its verdict on whether "the rules of the game" for appointment to various posts in the judiciary can be changed mid-way through the selection process. A five-judge constitution bench comprising Chief Justice D Y Chandrachud and Justices Hrishikesh Roy, P S Narasimha, Pankaj Mithal and Manoj Misra reserved the judgement after hearing the arguments advanced by the lawyers appearing for the parties. The top court had on November 24 last year agreed to form a constitution bench for examining the larger issue raised in a number of petitions about whether "the rules of the game" for appointment to various posts in the judiciary can be modified in the middle of the selection process. SC stays Gauhati High Court order of putting on hold WFI elections

The Supreme Court on Tuesday stayed an order of the Gauhati High Court which had put on hold the Wrestling Federation of India (WFI) elections. A bench of Justices Aniruddha Bose and S V Bhatti issued notices to Union Sports Ministry, Wrestling Federation of India, Assam Wrestling Association and others on a plea challenging the June 25 order of the high court. The counsel appearing for petitioner, Andhra Pradesh Amateur Wrestling Association, told the bench that a third party appeared before the high court on Sunday and got the matter stayed. He said the elections in the Wrestling Federation are getting delayed. The bench then proceeded to issue notice and stayed the high court order. Defamation case: SC to hear Rahul's appeal against Gujarat HC verdict

The Supreme Court on Tuesday agreed to hear on July 21 an appeal of Congress leader Rahul Gandhi challenging the Gujarat High Court's July 7 verdict which dismissed his plea seeking a stay on his conviction in a defamation case over his "Modi surname" remark. A bench of Chief Justice DY Chandrachud and Justices PS Narasimha and Manoj Mishra agreed to hear the plea after senior advocate Abhishek Singhvi, appearing for Gandhi, sought listing of the appeal on July 21 or July 24. Time for filing objections to IOA's draft constitution extended by 2 weeks

The Supreme Court Monday extended by two more weeks the time for filing objections to the draft constitution of the Indian Olympic Association (IOA) framed by former apex court judge Justice L Nageswara Rao. The top court also made it clear that the pendency of the pleas related to IOA will not preclude high courts from continuing with the hearing on pending petitions related to other sports bodies. SC extends interim bail given to Veerapan's associate on medical grounds

The Supreme Court on Monday extended the interim bail granted to Gnanaprakash, an associate of forest brigand Veerapan who was convicted under the stringent TADA for his involvement in the 1993 Palar blast in Karnataka, in which nearly two dozen policemen and foresters lost their lives. A bench of Justices Sanjiv Khanna and Bela M Trivedi directed for the continuation of the interim order of relief given to Gnanaprakash till further orders. Gnanaprakash (63), who has been in jail for 27 years, was granted interim bail on November 28, 2022 on health grounds on a petition filed by his wife, Selva Mary.
