Maharashtra political crisis: SC to commence hearing pleas on Feb 14

The Supreme Court on Tuesday said that it will commence hearing on February 14 on pleas related to the Maharashtra political crisis triggered by the Shiv Sena's division. A five-judge constitution bench headed by Chief Justice DY Chandrachud was told by senior advocate Kapil Sibal, appearing for the Uddhav Thackeray Shiv Sena, that he will will seek reference of the cases to a seven-judge bench to have a re-look of a 2016 judgment on powers of assembly speakers to deal with disqualification pleas. We have filed the submissions on reference of matters to a seven-judge bench constitution bench. They (Chief Minister Eknath Shinde faction of Shiv Sena) have filed the response, Sibal told the bench which also comprised justices M R Shah, Krishna Murari, Hima Kohli and P S Narasimha. Religious conversion shouldn't be given political colour: Supreme Court

Observing that religious conversion is a serious issue which should not be given a political colour, the Supreme Court on Monday sought the assistance of Attorney General R Venkataramani on a plea seeking direction to the Centre and states to take stringent steps to control fraudulent religious conversions. A bench of Justices M R Shah and C T Ravikumar asked Venkataramani to appear in the matter in which the petitioner sought a check on religious conversions through "intimidation, threatening, deceivingly luring through gifts and monetary benefits", and assist as amicus curiae. The Supreme Court has asked a petitioner, who has sought the court's intervention to declare the crisis in Uttarakhand's Joshimath as a national disaster, to mention his plea Tuesday for urgent listing. SC to hear pleas challenging validity of 1991 law on religious places

The Supreme Court is likely to hear on Monday a batch of PILs challenging the validity of certain provisions of a 1991 law which prohibit filing of a lawsuit to reclaim a place of worship or seek a change in its character from what prevailed on August 15, 1947. A bench of Chief Justice DY Chandrachud and Justice PS Narasimha has listed as many as six petitions, including those filed by former Rajya Sabha MP Subramanian Swamy, against the provisions of the law. On November 14 last year, Solicitor General Tushar Mehta, appearing for the Centre, had said that a comprehensive affidavit will be filed by the Union government dealing with various facets of the case and sought some more time to ensure that the affidavit is filed after due deliberation at various levels of the government. The rule of law plays a fundamental role in advancing democracy and curbing abuse of power by any branch of government, Justice Dinesh Maheshwari of the Supreme Court said here on Saturday. He was speaking on "Democracy and Judicial Legal System at an event here. Both (democracy and legal system) are extremely significant and complementary to each other. The respect for the rule of law and a well-developed justice system are the underpinnings of a democratic society and of course a modern economy also," he said.
