Unable to represent constituency due to court rider: Engineer Rashid to HC

Jammu and Kashmir MP Engineer Rashid, accused in alleged terror funding case, on Wednesday informed the Delhi High Court that he was unable to represent his constituency owing to a rider imposed on him to pay daily costs to attend the parliamentary session. Appearing before a bench of Justices Vivek Chaudhary and Anup Jairam Bhambhani, Rashid sought the modification of an order passed by a coordinate bench. The order directed him to deposit Rs 4 lakh with the prison authorities as travel expenses for attending Parliament. During the hearing, the bench remarked that when custody parole is granted, it is ordinarily at the cost of the person. At this, senior advocate N Hariharan, appearing for Rashid said the condition was unreasonable because "he (Rashid) is an elected representative of the people of a parliamentary constituency and unable to represent them due to inability to pay the same". Delhi HC seeks NIA's response on Abdul Rashid's plea in terror funding case

The Delhi High Court on Friday sought a response from the National Investigation Agency (NIA) on a plea by jailed Lok Sabha MP Sheikh Abdul Rashid seeking interim bail to attend the ongoing Monsoon session of Parliament. Rashid, popularly known as Engineer Rashid and in jail in a 2017 terror funding case, has also challenged a trial court order asking him to bear travel expenses of Rs 1.44 lakh per day for attending Parliament in custody from July 24 to August 4. A bench of Justices Vivek Chaudhary and Shalinder Kaur issued notice to the NIA on the plea and listed the matter for further hearing on July 29. The court is also scheduled to hear on July 29 Rashid's regular bail plea in the case. The Baramulla MP has been lodged in Tihar jail since 2019 after he was arrested by the NIA under the Unlawful Activities (Prevention) Act in the case. Terror funding case: HC rejects bail plea of separatist leader Shabir Shah

The Delhi High Court on Thursday dismissed a plea by Kashmiri separatist leader Shabir Ahmad Shah seeking bail in a terror funding case. A bench of Justices Navin Chawla and Shalinder Kaur pronounced the verdict while rejecting Shah's appeal challenging a trial court's July 7, 2023 order refusing to grant him bail. "The present appeal is dismissed," the bench said. The detailed order is awaited. The high court in August 2023 sought response of the National Investigation Agency (NIA) on Shah's appeal. Shah's counsel has sought bail on behalf of the appellant on the grounds that "it was a no material case". Delhi HC seeks NIA's reply on Engineer Rashid's plea in terror funding case

The Delhi High Court on Thursday sought the NIA's stand on a bail plea by Baramulla MP Engineer Rashid in a terror funding case. A bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar issued notice on the parliamentarian's appeal against a trial court order which refused to grant him bail on March 21. The bench also asked the National Investigation Agency (NIA) to respond to a separate plea by Rashid challenging the framing of charges in the case. It clarified that the NIA's reply shall be filed only with respect to the question of a delay of around 1,100 days in mounting the challenge against the charges. The court listed both cases for hearing on July 29. Rashid has been lodged in Tihar jail since 2019 after he was arrested by the NIA under the Unlawful Activities (Prevention) Act in the 2017 terror funding case.

HC permits virtual production of Yasin Malik in terror funding case

The Delhi High Court on Friday directed that separatist leader Yasin Malik be virtually produced before it from jail in connection with the NIA's plea seeking death penalty for him in a terror funding case. Allowing an application by the jail superintendent citing security concerns, a bench headed by Justice Siddharth Mridul said the Jammu and Kashmir Liberation Front chief, who is presently serving a life term in the case, need not be produced in person and modified an earlier order seeking his physical presence. In view of the matter, the order dated May 29, 2023 is necessarily modified to the extent that the jail superintendent is directed to produce Yasin Malik in the present appeal through video conferencing alone on August 9 and not in person, ordered the bench, also comprising Justice Anish Dayal. HC to hear on Aug 7 plea to virtually produce Yasin Malik in funding case

The Delhi High Court on Thursday listed for hearing on August 7 a plea for virtual production of separatist leader Yasin Malik from jail in connection with the NIA's plea seeking death penalty for him in a terror funding case. The application by the jail superintendent was adjourned after a bench of Justices Siddharth Mridul and Anish Dayal, which was scheduled to hear the request, did not assemble. The high court had on May 29 issued warrants for production of Malik, who is presently serving life term in the case in Tihar Jail, on August 9 when the NIA's plea for enhancement of sentence is listed for hearing. NGO terror funding case: Court sends Parvez, Mehraj to 10-day NIA custody

A court here on Wednesday granted the National Investigation Agency (NIA) 10 days' custody of two people accused in a case related to NGO terror funding. Principal District and Sessions Judge Dharmesh Sharma allowed 10 days of custodial interrogation of human rights activist Khurram Parvez and his "close associate" Irfan Mehraj on two separate applications by the federal agency for 12 days' custody of each of them. "I have heard the counsel for the accused persons and having regard to the facts disclosed in the two applications and to unearth the incriminating material and other links concerning their unlawful activities besides the aspect of confrontation with digital evidence, the applications are allowed and both the accused persons are remanded to police custody of the NIA for a period of 10 days," the judge said. SIA conducts raids at multiple locations in J-K in terror-funding case

The State Investigation Agency (SIA) conducted raids at multiple locations in Jammu and Kashmir on Saturday in connection with a terror-funding case, officials said. They said searches were conducted at multiple locations in south Kashmir's Anantnag and Kulgam districts. Those raided included relatives of Sarjan Barkati, who shot to fame during street protests in 2016, the officials said. They said the searches were carried out by the SIA sleuths, who were assisted by police and Central Reserve Police Force (CRPF) personnel. The searches were part of an ongoing probe into a terror-funding case, the officials said.
