Bombay HC stays demolition of 8 shops falling in metro route

The Bombay High Court today stayed a demolition notice issued to eight shops in suburban Andheri by the Mumbai Metro Rail Corporation Ltd (MMRCL) to pave the way for the Colaba-Bandra-Seepz Metro Line-3 project.

A division bench of justices A S Oka and Riyaz Chagla, while staying the notice dated April 3, made a prima facie observation that the MMRCL had no powers to carry out such demolition work.

The court was hearing a petition filed by the owners of the shops.

The petitioners said that they were ready to vacate their premises, but they should be provided with alternate premises as they were affected by the project.

 

The bench today issued a notice to the MMRCL and posted the petition for hearing on April 22.

"By way of interim relief, we direct that no steps of demolition or eviction shall be undertaken," the court said.
