The Madras High Court today dismissed the petitions filed by two ex-service men claiming quota of ex-service men in the Sub-Inspector selection made by the State Government.
P.Kandasamy and R.Nambiraj had filed the petitions to direct the The Chairman, Tamil Nadu Uniformed Services Recruitment Board, to follow five per cent reservation for Ex-Servicemen in the appointment to the post of Sub Inspector of Police (Taluk) 2015 as per notification dated February 8.
Justice D Hariparanthaman, in his order, said "as per the notification, the Grade Pay of the Sub Inspector of Police is Rs.4800. Hence, it is clear that the post of Sub Inspector of Police belongs to Group 'B' posts and not Group C as claimed by the petitioners."

"The five per cent reservation to ex-servicemen is given in the direct recruitment to Group 'C' posts as per Rule 22(ab) of the Tamil Nadu State and Subordinate Service Rules. Thus, statutory rules do not provide for reservation to ex-servicemen in Group 'B' posts."
The judge, while referring to a judgment of a Division Bench of the High Court, dismissed the petitions as not maintainable.
"In view of the Division Bench judgment, Rule 2A and Rule 22(ab) of the Tamil Nadu State and Subordinate Service Rules, referred to above, the writ petitions are not maintainable and the same are liable to be dismissed.
Pursuant to the notification, the petitioners had applied for the post of Sub Inspector. They appeared for the written examination. They were not allowed to participate in physical endurance Test on the ground that they did not secure the cut-off marks.
According to the petitioners, the post of Sub Inspector of Police belongs to Group 'C' posts. Since they were ex-Servicemen, they were entitled to claim ex-servicemen quota of five per cent in Group 'C' posts which was rejected by the judge.
