A 33-year-old man, who received grievous injuries after being hit by a JCB machine in 2013, has been awarded nearly Rs 15 lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer Naveen Arora asked Universal Sompo General Insurance Co Ltd, insurer of the vehicle, to pay Rs 14,68,300 to South West Delhi resident Kishan Singh, noting the victim had suffered 60 per cent permanent disability in his right lower limb and his right leg was amputated.
"His (Singh's) testimony on the aspect of rash and negligent driving remained unrebutted. Hence the respondent number 1 (driver) can be safely held for negligence for causing the accident," the tribunal said.
"I award Rs 14,68,300 to the petitioner (Singh) as compensation," it added.
According to the complaint, on March 5, 2013, Singh was hit by the JCB machine, being driven at a high speed and in a rash and negligent manner, while working on a construction site in in Gurgaon.
Due to the impact, he sustained injuries.He was taken to a nearby hospital and an FIR was registered in this regard.
Singh had told the tribunal he was a labour and claimed he was earning Rs 10,000 per month.
The driver, owner and the insurance company had denied the charges.
The tribunal after considering the age, job, dependency, medical expenses incurred, as well as pain and loss suffered by the injured and his family, arrived at the compensation amount of Rs 14,68,300.
