Road mishap: 44-yr-old woman gets over Rs 4 L compensation

A woman, who suffered grevious injuries after the car she was travelling in collided with a bus in Uttar Pradesh, has been awarded over Rs four lakh as compensation by a Motor Accident Claims Tribunal (MACT) here.

MACT presiding officer Rajender Kumar Shastri directed New India Assurance Company Ltd, insurer of the offending bus, to pay Rs 4,51,000 to north Delhi resident Neeta Bharadwaj after considering that she suffered severe injuries in her hands, legs and head.

"She suffered grievous injuries on both of her upper limbs and head. Steel implants were inserted in her legs to enable her to stand on her own feet," the tribunal observed while holding that the rashness and negligent driving of the bus caused the accident.
 

According to the complaint, in January 2010 when 44-year -old Neeta was travelling with her husband in their car, it collided head-on with a rashly-driven bus near Meerut in Uttar Pradesh.

Due to the impact, she suffered grevious injuries on both upper limbs and head and was rushed to a hospital.

The bus owner and driver denied the allegation and pleaded that they were falsely implicated in the case.

The tribunal also issued notice to the bus driver after it found that the driving licence submitted by him was fake.

It gave liberty to the insurance company to recover the compensation amount from the owner of the bus as it was able to prove that its driver used a fake licence and the bus lacked permit.
