The special court for CBI cases here today granted bail to two police constables arrested in the 2003 Sadiq Jamal fake encounter case.

Judge M M Gandhi granted bail to Ajaypalsinh Yadav and Chhatrasinh Chudasama, observing that prima facie there was no evidence against them.

Advocate Priyesh Limbachiya, their lawyer, had argued that CBI had found no evidence indicating their overt role in the encounter.

Jamal, a resident of Bhavnagar, was killed in encounter by Gujarat Police near Galaxy Cinema in Naroda area here on January 13, 2003.

But the genuineness of the encounter became an issue after Mumbai-based journalist Ketan Tirodkar told a court there that he was witness to Jamal's hand-over to Gujarat Police by the 'encounter specialist' officer Daya Nayak of Mumbai Police a few days before the alleged encounter.

The High Court had ordered a CBI probe on a petition of Sabir Jamal, Sadiq's brother. CBI has chargesheeted seven police officers in the case.
