No forward movement on 4 names reiterated by Collegium headed by CJI

There has been no forward movement on the names reiterated by the Supreme Court Collegium headed by Justice D Y Chandrachud for appointment as high court judges as he demits office as the chief justice of India on November 10. The collegium had in January 2023 reiterated the names of advocates Saurabh Kirpal for elevation as a judge of the Delhi High Court, R John Satyan as judge of the Madras HC, and Amitesh Banerjee and Sakya Sen as judges of the Calcutta High Court. The top court collegium had also reiterated the name of Somasekhar Sundaresan, also an advocate, as judge of the Bombay High Court in January 2023. In November that year, he was elevated as a judge of the Bombay HC. People aware of the procedure to appoint high court and Supreme Court judges said the files relating to Kirpal, Satyan, Banerjee and Sen are still pending with the government. Justice Sanjiv Khanna is new Chief Justice of India, to take oath on Nov 11

Justice Sanjiv Khanna was on Thursday appointed the 51st Chief Justice of India. He will take oath on November 11, a day after incumbent Justice D Y Chandrachud demits office on attaining the age of 65. Justice Chandrachud took over as the CJI on November 8, 2022. Justice Khanna will have a tenure of a little over six months as CJI and would demit office on May 13, 2025. "In exercise of the power conferred by the Constitution of India, Hon'ble President, after consultation with Hon'ble Chief Justice of India, is pleased to appoint Shri Justice Sanjiv Khanna, Judge of the Supreme Court of India as Chief Justice of India with effect from 11th November, 2024," Law Minister Arjun Ram Meghwal posted on X.

SC defers hearing on pleas for criminalising marital rape by 4 weeks

Chief Justice D Y Chandrachud, who is demitting office on November 10, Wednesday deferred by four weeks hearing on pleas challenging the immunity granted to husbands in cases of marital rape. At the outset, a bench comprising the CJI and justices JB Pardiwala and Manoj Misra, which commenced final hearing on October 17 on the pleas, asked lawyers about the time they would be needing individually to argue. Senior advocate Gopal Sankaranarayanan, appearing for a party, said he will take at least a day to complete his submissions as he did not want to stifle the elaborate pleadings needed to be advanced in an important matter like this. Institutional trust in courts and their credibility is the very basis of a thriving constitutional order, Chief Justice of India (CJI) D Y Chandcrachud said on Wednesday. The CJI was speaking at the Bhutan Distinguished Speakers' Forum, a part of the Jigme Singye Wangchuck Lecture Series, on the subject of 'Judicial Legitimacy through accessibility, transparency and technology: the Indian experience'. Dealing with the issue of public trust, the CJI said that courts do not directly hold resources as trustees of people. But as public functionaries, the courts are vested with the responsibility to give effect to equity, and judicial bodies are not directly in charge of the manner in which resources are distributed, he said. Need to create awareness about rare diseases in society: CJI Chandrachud

Chief Justice of India DY Chandrachud on Saturday emphasised on the need to create awareness about rare diseases among the society, on being empathetic and supportive to such parents and their families regardless of cultural, religious or traditional barriers. He said we can no longer afford to be unaware of genetic diseases. Citing the National Policy of Rare Diseases launched by the Ministry of Health and Family Welfare in March 2021, he said that further research is necessary to define the definition of rare diseases and stressed on the need to ensure equitable access to advanced medical therapy like gene therapy in a diverse nation like India. Ceiling on net borrowing: SC to set up 5-judge bench to hear Kerala's plea

The Kerala government on Friday moved the Supreme Court seeking early setting up of a five-judge Constitution bench to hear its lawsuit against the Centre raising the issue of ceiling on net borrowing. The state government has raised a question whether a State has an enforceable right to raise its borrowing limits from the Union government and other sources.
