Labour court asks Lufthansa to reinstate 17 terminated during pandemic

A labour court has directed Deutsche Lufthansa AG to reinstate 17 cabin crew members whose services were terminated during the coronavirus pandemic. The services of these people were terminated in February 2021 and they were members of the Lufthansa Cabin Crew Association. In an order passed on July 3, the Central Government Industrial Tribunal-Cum-Labour Court in the national capital said that 17 cabin crew members should be reinstated with "full back wages and continuity of service from the date of termination of service". Further, the tribunal has directed the airline group to pay them their last drawn salary and the arrears within two months from the date of publication of the award without interest. In case of failure to do so, the amount accrued would carry an annual interest of six per cent from the date of the challenged dismissal and till the amount is finally paid, it added. Documentary row: Delhi court summons BBC, others on defamation complaint

A Delhi court on Wednesday issued summonses to the BBC, Wikimedia and Internet Archive on a criminal complaint filed by a BJP leader seeking to restrain them from publishing a documentary on the 2002 Gujarat riots, or any other material defamatory to the RSS and Vishva Hindu Parishad (VHP). The complainant had said the BBC documentary "India: The Modi Question" has defamed organisations like the BJP, RSS and VHP. The court was told that though the documentary has been banned by the government, a Wikipedia page dedicated to the series provides links to watch it and that the content is still available on Internet Archive. Wikimedia Foundation funds Wikipedia while Internet Archive is a US-based digital library. Conman Sukesh Chandrasekhar moves court seeking transfer of extortion case

Sukesh Chandrasekhar, the alleged conman accused of extorting Rs 200 crore from the wife of a prominent businessman, Monday moved a Delhi court accusing the judge hearing the case of bias and seeking its transfer to another judge. Chandrasekhar filed an application before Principal District & Sessions Judge Dharmesh Sharma. HC allows listing of police plea, challenging Sharjeel Imam discharge order

The Delhi High Court Friday allowed urgent listing of a plea by the city police challenging a trial court's order discharging 11 people, including student activists Sharjeel Imam and Asif Iqbal Tanha, in the 2019 Jamia Nagar violence case. The plea was mentioned by Solicitor General Tushar Mehta before a bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad which allowed it to be listed for hearing on February 13. The law officer said the court registry has raised certain objections in the petition. The petition by police was filed on February 7 challenging the trial court's February 4 order discharging 11 persons, holding that they were made "scapegoats" by police and that dissent has to be encouraged, not stifled. The Supreme Court on Tuesday ruled that armed forces can take action against their officers for adulterous acts, as it clarified the landmark 2018 judgement that decriminalised adultery. A five-judge Constitution bench headed by Justice K M Joseph said its 2018 judgement was not concerned with the provisions of the armed forces acts. The top court, on a plea filed by NRI Joseph Shine, in 2018 had struck down Section 497 of the Indian Penal Code dealing with the offence of adultery, holding it unconstitutional. The Tuesday order by the bench, also comprising justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy, and C T Ravikumar came after Additional Solicitor General Madhavi Divan, appearing for the Centre, submitted a plea seeking clarification of the 2018 judgement. SC to consider govt's plea for open court hearing of petition on Benami law

The Supreme Court on Tuesday agreed to consider the Centre's submissions for an open court hearing of its plea seeking review of the judgement by which several provisions of the Benami Transactions (Prohibition) Amendment Act, 2016 were struck down. A three-judge bench headed by then CJI N V Ramana, since retired, on August 23 last year had struck down section 3(2) and section 5 of the Benami Transactions (Prohibition) Act, 1988, and one of the provisions which provided for the punishment of a maximum jail term of three years or a fine or both for those indulging in benami' transactions.
