Human trafficking case: SC says it's a serious matter, will monitor probe

The Supreme Court today said it would monitor the investigation into a human trafficking case in Maharashtra and asked the Acting Chief Justice of the Bombay High Court to constitute an exclusive bench for hearing bail applications of accused in the case. The apex court directed the Maharashtra government to appoint a special public prosecutor to ensure free and fair trial in the case in which 68 girls, hailing from Rajasthan, were rescued from Maharashtra. A bench of Justices J Chelameswar and Sanjay Kishan Kaul said that it was a very "unfortunate situation" and directed that an Inspector General of Police-rank officer should supervise the investigation into the case. "This is a serious matter and police officers involved in the case should investigate the matter properly. What is more worrying is the role played by the parents of the girls as there is no missing complaint filed. There may be some financial consideration for them," the bench said. BCI urges Jaising to withdraw statement on SC judges

The Bar Council of India (BCI) today urged Indira Jaising to "withdraw" her reported statement against the apex court judges who had passed the SC/ST verdict on March 20 but the senior advocate asserted that she neither attributed motives nor questioned the integrity of the judges. BCI Chairperson Manan Kumar Mishra, in a statement, said that the courts and the judges are the breath and soul of democracy, but it has now become a fashion to degrade them. He also said that the judiciary is the only institution in which the people have "blind faith and trust" and no judge acts with any feeling of casteism or with any other extraneous consideration. Lax Delhi government lost Rs 67 crore: CAG

Lack of timely and effective action by the Rural Develpoment department regarding land lease allotment to the Municipal Corporation of Delhi resulted in non-recovery of around Rs 67 crore, a report of the Comptroller and Auditor General (CAG) tabled in the Delhi assembly by Deputy Chief Minister Manish Sisodia on Tuesday said.

NCR: Girl, lesbian partner kill mother for objecting union

Police today arrested a 21-year-old woman here who killed her mother as she objected to her lesbian relationship with her teacher. On March 9, Rashmi Rana's father Satish Kumar lodged an FIR at Kavi Nagar police station against his daughter and her teacher Nisha Gautama for battering his wife Pushpa Devi with an iron rod which later caused her death. Police arrested Rana and Gautama from Ghaziabad railway station today. During interrogation, Rana confessed that her mother opposed the union and constantly tortured her over it. "Fed up with the objections, Rana and her teacher killed Pushpa Devi by battering her with an iron rod who died due to serious head injuries," said SP City Akash Tomar. Devi's husband, Satish, was not in the house during the incident. "The duo has been sent to jail," said Tomar.

SSC exam case: Four arrested by Delhi Crime Branch

The Delhi Police Crime Branch on Tuesday arrested four people involved in enabling cheating online in the Staff Selection Commission (SSC) examination.SSC examination was busted on March 27 in a joint raid by the Delhi Police and the Uttar Pradesh Special Task Force (STF).Earlier on March 28, the Uttar Pradesh Police had initially arrested four accused in the case, who used to help candidates cheat in the exams with the help of an online app called 'Team Viewer'.An FIR has been registered in the matter and further investigation has also been initiated.

ED grills Delhi min Satyendar Jain in PMLA case

The ED today questioned Delhi Health and Power Minister Satyendar Jain in connection with a money laundering case registered against him and others. Officials said Jain was summoned under the Prevention of Money Laundering Act (PMLA) and his statement was recorded by the investigating officer of the case. He was grilled for over three hours, they said. The PMLA case was registered by the Enforcement Directorate (ED) last year in August on the basis of a CBI FIR. The Central Bureau of Investigation (CBI) complaint had said Jain could not explain the source of funds received by four companies in which he was a shareholder. It had registered a case against him, his wife and four others on charges of money laundering. The CBI has questioned him in the case earlier. CBI sources had said that Rs 4.63 crore was allegedly received through Prayas Info Solutions, Akinchan Developers, Managalyatan Projects and Indo-Metal Impex Pvt Limited in 2015-16. SC/ST Act row: No bar on paying compensation or lodging FIR, says SC

The Supreme Court today made it clear that there was no bar either on paying compensation and other immediate relief to victims belonging to Scheduled Castes and Scheduled Tribes or registration of FIR under any provision of law in its March 20 verdict putting in place certain safeguards on arrests under the SC/ST Act. The apex court, which entertained the review petition filed by the Centre against the verdict, also said there was "no dilution" of any provision of the SC/ST Act relating to compensation, trial or punishment in its judgement. "A perusal of the order of this court makes it clear that there is no bar to compensation or other immediate relief being given to the victim member of the SC/ST as per the provisions noted above without any delay whatsoever," a bench of justices Adarsh Kumar Goel and U U Lalit said. CBI books 5 men for trafficking 11 boys to US

The Central Bureau of Investigation (CBI) on Tuesday registered a case against five persons for allegedly taking 11 teenage boys from Punjab to United States of America on pretext of an educational trip.It was alleged that the accused persons submitted false and fabricated documents to the US Embassy for obtaining non-immigrant visa for the said 11 boys and one of the accused.All the teenage boys were allegedly shown as students of a school in Punjab. Court discharges AAP MLA in six cases of extortion

The Delhi's Patiala House Court on Tuesday discharged Aam Aadmi Party (AAP) MLA Manoj Kumar in six cases of extortion filed against him in August 2015.The court discharged him citing lack of evidence.The court, however, framed charges against Kumar's personal assistant and co-accused Deepak Sharma on the same.Around 17 FIRs were registered on the complaint of ration shop owners of East Delhi in 2015 against Sharma, stating that the MLA was extorting Rs 2000 from them every month.As per reports, Sharma also threatened to cancel the license of the ration shop owner, if they refused to pay them.

Out on bail comedian booked again by cops

BJD leader and comedian Papu Pompom alias Tatwa Prakash Satpathy, who was released on bail by Orissa High Court in an alleged casting couch case, was today booked by Cuttack city police for allegedly misbehaving with a woman advocate. The advocate, associated with a Bhubaneswar-based NGO that was instrumental in "exposing" the actor in the 'casting couch' case in 2016, has alleged that the comedian along with two of his accomplices had misbehaved with her in a hotel located in Cuttack Sadar area last week, police said quoting her complaint. She lodged the complaint with the police today. Papu Pompom had secured bail in the 'casting couch' case in October 2016. "On the basis of a written complaint, the Cuttack sadar police of the city has been entrusted to proceed in the case after conducting investigation," city deputy commissioner of police Akhileswar Singh said here. The police have already interrogated the hotel staff in this connection, he said.

Article 370 not a temporary provision, says SC

The Supreme Court today said that Article 370 of the Constitution which gives special status to Jammu and Kashmir is not a temporary provision. The apex court said that in its earlier verdict of 2017 in the SARFESI case, it has been already held that Article 370 was "not a temporary provision". "The issue concerned is covered by the judgement of this court in the 2017 SARFAESI matter, where we have held that despite the headnote of Article 370, it is not a temporary provision," a bench of justices A K Goel and R F Nariman said. Bitter legal battle ends as Kejriwal apologises to Jaitley

A bitter legal battle between Arun Jaitley and Arvind Kejriwal over defamation cases in the courts here came to an abrupt end today as the union minister accepted the apology tendered by the Delhi chief minister who had made allegations of financial irregularities in the DDCA during his tenure as its President. Innocents cannot be terrorised by the provisions of the SC/ST Act and their fundamental rights need to be protected, the Supreme Court today said as it refused to keep its March 20 verdict in abeyance. The apex court said that it is not against the SC/ST Act and the "provisions of anticipatory bail have been introduced as unlike other laws, no forum was available for the innocents to seek remedy under the Act". "We have said that innocents should not penalised. The innocents cannot be terrorised by the provisions of the SC/ST Act. We don't want to deprive anyone from right to life and we make ourselves very clear that we are not against the Act or the complainants," a bench of justices Adarsh Kumar Goel and U U Lalit said while justifying directions given in the March 20 verdict which created much furore across the country. Aadhaar law is just, fair & reasonable: Centre to SC

The Centre today justified the Aadhaar Act in the Supreme Court, saying it was a "fair and reasonable law" which complied with the tests prescribed by the historic verdict on the right to privacy. A nine-judge constitution bench, on August 24 last year, had declared the right to privacy as a fundamental right and termed it as an intrinsic part of right to life and personal liberty under Article 21 of the Constitution. The Centre today referred to the verdict and said the reasonable restrictions, which are applicable on right to life, would also govern the right to privacy. It told a five-judge constitution bench headed by Chief Justice Dipak Misra, which is examining the validity of Aadhaar scheme and its enabling 2016 law, that the privacy verdict provided that State can seek certain information if there is a law, a legitimate state interest and the proportionality doctrine to weigh citizens' privacy and the State's interests. HC seeks Centre's reply on pleas of Shakti Mills rape convicts

The Bombay High Court today gave the Union government time till April 24 to file reply on petitions filed by three convicts in the Shakti Mills gang-rape case challenging constitutional validity of the law under which they were sentenced to death for a repeat offence. A bench of Justices R M Savant and Sarang Kotwal directed the Centre to file affidavits, explaining the amended provision of the Indian Penal Code which prescribes life sentence or the capital punishment for repeat offenders in rape cases. Three of the five persons who were convicted by the sessions court here in 2014 -- Vijay Jadhav, Kasim Bengali and Salim Ansari -- have moved the high court. Bengali and Ansari challenged the sessions court order allowing the prosecution to invoke Section 376 (E) of the IPC when the trial was underway.
